Default Court: NFL is 32 teams, not single business

WASHINGTON – The Supreme Court says the National Football League can be considered as 32 separate teams - not one big business - when it comes to to selling NFL-branded items like jerseys and caps.

The high court has unanimously reversed a lower court ruling throwing out an antitrust suit brought against the league by one of its former hat makers.

American Needle had sued the league after losing the contract to Reebok. The company said the NFL violated antitrust law because all 32 teams worked together to freeze it out of the NFL-licensed hatmaking business. The NFL said it did not violate antitrust law because the teams are all one business.

The lawsuit now goes back to district court.

Odd considering the teams have never been able to independently decide which manufacturer to use for uniforms, etc. Every team has had to use the same one. I wonder if that will change now, with some teams sporting reebok, others Nike and others Adidas depending on whatever deal they could negotiate.

This actually a good ruling for the little guy. The ramifications of saying the major league sports are considered one business would mean bad things. Each league could monopolize their rights even further and theoretically cheat and pick championship winners every year (if you don't believe they already do that) and legally there is nothing anyone could do anything about it.

I thought I remember back a few years (late 90's?) teams did get to decide who made their uniforms? I feel like I some teams were wearing Nike, some Wilson, etc. Maybe I am wrong....

I think you're correct. I can remember seeing HC's wearing that great apex stuff in the early 90's on the sidelines at least

2002 was when Reebok's exclusive Uniform and accessories deal began (When the Texans came on board and realignment occurred). Prior to that teams could choose.

This is a huge win for the players union, if the NFL was treated as a single entity it would be imune to antitrust legislation, as it stands now the NFL must abide by antitrust legislation and thus they must have a CBA with the union. If the NFL could be treated as a single entity they would not be required to negotiate with the union at all.

This strengthens the unions case a lot coming into the next round of negotiations.

No it doesn't. Did any of you even read the case? This had nothing to do with collective bargaining. They were considered 32 businesses before this ruling, and the NFL was trying to get that changed. The NFL was trying to make the court rule that they weren't so they could monopolize all the trademark rights for all 32 teams as well as uniforms.

This has nothing to do with CBA. It was never connected to it and all the ruling means is the status quo stays the same and the NFL, MLB, NHL, NBA et al can't mandate buyers for their wares across the board. If they want to do so, each individual team will all have to agree now.

This is a good thing.

So does this mean EA finally loses its monopoly? Their Madden game has stunk for years and I didn't buy it last year since it was the same regurgitated crap.
