Default My trial is tomorrow

Told spider the whole story, if he wants he can get more into it. Ill probably tell more once this is over, not cuz Im just hiding shlt, but just don't feel like going into it right now.

Being charged with Assault, Harrassment, and a Domestic Violence tack on. Basically what happened short version, last July I was taking her home from work, she tried starting an argument over some stupid bullshlt, I didn't want to hear it, she kept trying to egg me on, I turned up my radio, she kicked the radio and started slapping me, had me in the other lane of traffic, right open backhand I swatted her back, not closed fist or anything, I didnt hurt her, she then flipped on me, WITH closed fists, hitting me, I threatened to kick her out of the truck, and she waited about a week afterward when immigration told her that she was good to be here for another 10 years to file her complaint.

DA offered for me to plead guilty to DV and Harrassment, and I'd have to go to anger management classes and be on probation and have a deferred judgement, I told em to go to hell, because I will not plead guilty to that. So we're gonna see what a jury thinks. IT WILL BE NICE TO FINALLY GET ON THT STAND AND HAVE MY SAY, ALTHOUGH i AM NERVOUS AS HELL. Dont think a conviction would get me any jail time but the max penalty is 18 months. Just find it interesting that I have been beaten, had objects thrown at me which have caused bruises, and had a knife pointed at me, yet in Park County's mind I am the violent one. Unreal.

Bigger issue is that this might be a big battle in the ongoing war for custody of my son, who is my life, and the only one that means a damn thing to me in this world. Without him I am nothing. And he would be better off with his dad than his mom.

So, if you are religious, just pray for the truth to get out and/or for justice to be done. I am not asking for prayers for an acquittal, I simply want justice.

Might have all been orchestrated. Once you have a DV on your rap sheet, you can forget about custody. And if the kid is a minor, she'll also keep her anchor child not to be deported. You got pwned, son.

Ive been in this situation before and i know its tough to hold back.

All i did was grab my ex and the police were there.

Hope you have a GOOD attorney, if not that "backhand" will cost you dearly. As Bob mentioned, it may drastically reduce your chances of gaining custody.
I went through the custody battle, and the "family judges" generally frown on any DV charges.

Hang tough bro , I am in your corner ......... let it out while you are up on the stand that this a set up tell the jury she picked this fight with you cause you want custody , you want to be part of your sons life , and getting a DV charge will insure she gets to set the rules over visitation......

Check this out . One of My Brothers that lives in Greeley colorado got into fight with his wife , She smacked him in the head with the phone , drew blood , he pulled the phone out of the wall and threw it outside ....... My Brother was charged and thrown in Jail for domestic violence ....... She stayed at home . My Brother is even bigger then me 6-5 260 pounds thin ..... Big guys get no break in Domestics ...........

In almost all DV situations, police arrest the MAN regardless of who started it or who got the worst of it on the assumption that the man can do greater harm if the situation reignites. It's practically standard police procedure now.

The general public doesn't understand that and assumes that if the MAN was arrested then he must have been the culprit.

Yeah I can see that line of thinking ... and it does make sense ........ My wife is 110 pounds soaking wet , 5'0 even .... when she pisses me off , I just go to my rig and sit in the truck stop

I have been in a "relationship" where the woman struck me. I didn't retaliate for the very reason that I would have been the one hauled off to jail. I just told her to go away. Eventually, she did...

The problem, of course, is that women figure out the rules of the game and know their violence will go unpunished. It's like children who have learned that all they have to do is hint at parental abuse to get the upper hand in any school/legal dispute with their parents.

It's even worse for the man because if the woman beats him up, he gets no sympathy even from other men. Then HE goes off to jail and, if there is a divorce, HE is the one that has to shell out alimony and child support.

If you explained the legal consequences of marriage to men in the modern 21st century American courts, removing any emotion from it, most men would see they are agreeing to legal suicide when they say "I do". The woman is entitled to beat you up and leave you penniless and the courts are cool with all of it, especially if she has kids and the kids don't even have to be ones you fathered.

Granted, there are a lot of scummy men out there but there are also women who know how to rig the system to clean a man out of everything he's worked for and will see no punishment at all for doing so. In fact, if she's good looking, there will be other men lining up to be her next victim.

I do pray for the truth spdirty, for your son's sake. I hate women who use their sex to abuse the law and lie. If that's the case here I hope you have people who see through it. I also pray that your son has the full advantage of both parents. I don't believe the child can help her stay in the country though. My daughter's sister-in-law has two children born in this country and was deported. Also most judges, regardless of DV (unless there is proof they are against the child), will make visitation provisions and make her abide by them. You may have to pick the child up at a neutral site but I'm sure that would be fine.

Not Guilty of all charges!!!!!!!!!!!!!!!!!

I loved it, my ex got up there and her lies were utterly exposed as lies. She said that I directly punched her, when she testified last July that I did do a backhand.

With me, the DA tried to screw me up with my testimony but I made him look like an idiot. I said she kicked the radio, he sadi that I never wrote that in my statement, I said yes I did, he showed it to me to read it, and I read "she kicked the radio, pulled the knob off the radio, and was slapping me."

I tell you guys, I have never ever ever felt this VINDICATED in my life.

I mean that jury took literally 15 minutes of deliberation before coming up with a verdict. So in my book, it isnt only a win, its a blowout.

Funny though, I remember being asked what her state of mind was, and I said "dangerous." And my lawyer said "well, describe to me what she was like." And I said "well, I know how she gets when she is like this, and in the past when she has gotten like this she has hit me, threw a picture frame at me causing a bruise, and she has pointed a knife at me." "Objection!" "Sustained." And I was thinking, "yeah I'd like to crawl in the same snuggie wither, but I got it out."

I just love the truth and I am just so glad and relieved that justice was delivered today. Now the next battle is getting my son. I got him tonight, so today was just a slam dunk perfect day for me.

Thanks for the thoughts guys, and for those who prayed, I thank you. They worked. The truth was heard.

you know whats funyny, the jury gets to ask the witness any questions they may have. So one of the jurors asked me "how much can you bench press." I said"well I can lift a 60 pound poinjar but I haven't been to the gym in over 4 years so I couldn't tell you." Got a luagh from everyone, including the judge.

Judge grinned from ear to ear when it was done too. Also, one of the jurors looked at me, smiled and nodded. That was cool.

But spider, you were a good friend when this crap was going down, and you were on my side. Your a good man, no matter what anyone says about you.

But, never in my life will I be in s=this situation again. I believe that I did the right thing. But I will not be associating myself with hotheaded women anymore. Just love how the victim advocate lesbos and the DA were more than willing to take her word for everything. And now they all look like jackasses. I mean 15 minutes, the jurors didnt even argue in deliberation.
