Ex-pastor defends acts
His attorney argues that the minister had a right to solicit sex from an undercover policeman.

OKLAHOMA CITY | The attorney for a former Baptist church leader who had spoken out against homosexuality said Thursday that the minister has a constitutional right to solicit sex from an undercover policeman.

The Rev. Lonnie W. Latham had supported a resolution calling on gays and lesbians to reject their “sinful, destructive lifestyle” before his Jan. 3, 2006, arrest outside the Habana Inn in Oklahoma City.

Authorities allege that Latham asked the undercover policeman to come up to his hotel for oral sex.

Latham’s attorney, Mack Martin, filed a motion to have the misdemeanor lewdness charge thrown out, saying the Supreme Court ruled in the 2003 decision Lawrence v. Texas that it was not illegal for consenting adults to engage in private homosexual acts.

“Now, my client’s being prosecuted basically for having offered to engage in such an act, which basically makes it a crime to ask someone to do something that’s legal,” Martin said.

Both sides agree that there was no offer of money, but prosecutor Scott Rowland said there is a “legitimate governmental interest” in regulating offers of acts of lewdness.

The American Civil Liberties Union of Oklahoma has filed a brief alleging that Latham’s arrest also violated his right to free speech.

Before his arrest, Latham had spoken against same-sex marriage.

He has since resigned as pastor of the South Tulsa Baptist Church and stepped down from the executive committee of the Southern Baptist Convention, where he was one of four members from Oklahoma.

normally I would use this to rail against Christians , throw out a few insults , but for some silly reason that causes Christians to get defensive and I ma the bad guy

Last week, Arizona's legislature rejected a measure that would have banned vehicle splash guards bearing racist terms or silhouettes of naked women.

thats stupid. I have bull balls and love em. Guess this isone of those 1% of the times the ACLU is right. Still believe they are evil.

Yep, nothing more evil than Americans trying to protect the rights of other
Americans as guaranteed by the United States Constitution by taking their
cases to the body set up to determine Constitutional rights, the United
States Supreme Court. Let's just scrap the Constitution, it's the source
of all evil when you really get down to it, and let King George W and his
minions decide what it best for us. After all, King George W has never been
wrong yet, has he?

no, they 'defend' some of it. You want an organization that defends the whole constitution try the aclj.

Yeah well, most people didn't even know what the ACLU was until George The First dragged them through the mud during his 1988 campaign....I find it laughable that that impression still exists some twenty years later.

spdirty, I've been a "card-carrying member" since 1993, and I can tell you - positively - that the ACLU defends anyone with a Constitutionally protected issue - period. ANY free speech, ANY free religion, etc....




Perhaps you've never taken the "acid test" of American citizenship: "Freedom of speech means that no matter how violently I disagee with what you say - no matter how much your opinion roils my blood - I would defend to the death your right to say it."

"Death" may be over the top by today's standards, but think about that.

I mean really, really think about that.


And then examine why it is you're so upset about the ACLU and our speech case defenses.
