Default legality of redistributing Xbox 360 and PS3s

I'm sure there are people out there who bought xbox 360s and are now selling them on Ebay for inflated prices.

So let me ask what are the legal limits of this?

Lets say someone bought 30 PS3s through preorders, somehow, and sold them all on Ebay just for the money made off the price correction, is that illegal? how? And how do these people keep getting away with it? there must be a loophole i guess.

And another question how do these guys get their hands on so many 360s in teh first place? sometimes i see the same user on ebay selling them over and over again!

no clue about us laws, but technically, if you own something, you can sell it on. cant see why it should be illegal to sell something you own.
