Default Corporations and Carpool Lanes

When Jonathan Frieman of San Rafael, Calif., was pulled over for driving alone in the carpool lane, he argued to the officer that, actually, he did have a passenger.

He waved his corporation papers at the officer, he told NBCBayArea.com, saying that corporations are people under California law.

The SCOTUS has ruled that corporations are persons. So are they, or not?

They are persons for certain applications of law but I work in this field. Not saying i am an atty i am not but i can tell you a judge will simply make him pay the fine and any appeal his files he will lose. He could even get in trouble if he wastes too much of the courts times.

Obviously corp papers are only the documents of a corporation not the corporation itself. Its a funny story I agree but it has no legs and is obviously a stupid waste of the courts time.

Actually, a corporation is only a box of papers. That's why they exist - to serve as a buffer against responsibility.

I really think the Carpool violation fine should be something like $10,000. Something insane.

It pisses me off watching the cheaters when I'm stuck in traffic. The fine just isn't detrimental enough (and it's not a moving violation on your record) for people that make decent money not to exploit it.

Or allow PAY-PER-Carpool, type lanes. We have a few in WA, actually.

I also don't think Mom's should be allowed to use their 2 year old as "Carpool relevant occupants". It should ONLY be people with a Drivers License (Or old enough to have one). It's not like that 2 year old urgently needs to get anywhere.

Sorry rho the papers only represent the people who make up the ownership of the corporation, the officers, the bylaws etc etc. Good try though I agree funny story.

What about letting anybody in a company vehicle, you know somebody who is contributing to society actually use them, or heres a novel idea, get rid of them, they are a failed social engineering experiment, make 2 lanes that everybody could use in the space of the 1 car pool lane and get everybody to where they have to be a little faster.

what about motorcycles ? up here they cant use them, which makes no sense to me, if 2 out of 4 or 6 seats in a car can use them ( 33-50% ) why cant a bike which may be 100% full or at least 50%.

But at the same time, green cars can, so hybrids can, im still waiting for the company to come out with hybrid stickers for all cars to cheat.
