"Imminent lawless action" is a standard currently used, and that was established by the United States Supreme Court in Brandenburg v. Ohio (1969), for defining the limits of freedom of speech. Brandenburg clarified what constituted a "clear and present danger", the standard established by Schenck v. United States (1919), and overruled Whitney v. California (1927), which had held that speech that merely advocated violence could be made illegal. Under the imminent lawless action test, speech is not protected by the First Amendment if the speaker intends to incite a violation of the law that is both imminent and likely. While the precise meaning of "imminent" may be ambiguous in some cases, the court provided later clarification in Hess v. Indiana (1973). In this case, the court found that Hess's words did not fall outside the limits of protected speech, in part, because his speech "amounted to nothing more than advocacy of illegal action at some indefinite future time,"[1] and therefore did not meet the imminence requirement.

"I'm gonna sue you for everything you own" is a pretty common saying. I take it to be a third person twist on that. Even if he personally doesn't like the guy, it's not necessarily for racial reasons. Maybe Spike Lee kicked his dog?

The confusion seems to stem from the fact the woman's son is named William George Zimmerman and he lived briefly at the address in 1995.

When William Zimmerman pleaded with the man who tweeted the address, the man responded, "Black power all day. No justice, no peace" along with an obscenity.

Neighborhood Watch volunteer George Zimmerman shot and killed Martin in a Sanford gated community on Feb. 26, with emotions and anger running at fever pitch while he remains free.

William Zimmerman said he used his mother and stepfather's address to register a car, get a drivers license and vote when he lived there after college.

"This is really scary, and I'm concerned for my family," William Zimmerman said. "It's scary because there are people who aren't mentally right and will take this information and run with it.

"To endanger people who are innocent because people are angry is not the answer. That's not how we're going to heal. It's not [going] to help the Martin family for someone else to be hurt."

An elderly Florida couple has been caught in the cross hairs of the Trayvon Martin shooting case due to an incorrect tweet by Spike Lee and others.
The director retweeted an address said to belong to George Zimmerman, the man who shot Trayvon Martin dead on Feb. 26, to his 250,000 followers, according to website thesmokinggun.com. But the address was incorrect and has caused the couple to go into hiding.
David McClain, 72, and his wife Elaine McClain, 70, are now living in a hotel and said they are concerned for their safety.
“We’re afraid for our lives,” Elaine McClain told WKMG-TV in Orlando.
McClain said her son’s middle name is George and his last name is Zimmerman, but he hadn’t lived at the residence since 1995.
Elaine McClain has heart problems, and when contacted by ABCNews.com, said she was not doing well and was heading out to a doctor’s appointment. McClain said she and her husband parked around the corner from their home and were briefly stopping by to grab clothes and other necessities.
The tweet originated from an account with the twitter handle @MACCAPONE, The Smoking Gun Reported. The account, which is the handle for a Los Angeles man named Marcus Higgins, tweeted the address at various celebrities. Lee was the only one to retweet it.
The director was active on Twitter today, retweeting negative messages he has received since sharing the McClains’ address.
Elaine McClain said Lee owes her and her husband a “big apology”.
As for now, the official word from Lee’s representatives? “No comment” <-- he did later apologize but still they should sue him into poverty still its what i would do. also herman the cheatin on women thing only works for billy

according to the above, Spike did nothing illegal. immoral maybe, but not illegal. now whether they can show some kind of personal or financial injury, who knows.
