Default Judge orders new round of discovery on Clinton emails / Obama State & DOJ "bad faith"

From the scathing order:
...One of the gravest modern offenses to government transparency...the government's respons to a FIOA request smacks of outrageous misconduct. And these cases merit additional discovery into the government's motives... The Court takes no pleasure questioning the intentions of the nation's most augus executive departments. But it still remains unknown whether Clinton used a private email to duck FOIA requests...agencies violate FOIA when they fail to search records an employee improperly secreted from the agency's control.

To see if it can rule out egregious government misconduct and vindicate the public's faith in the State and Justice Departments, the Court orders the parties to meet and confer to plan discovery into whether Clinton used a private email to stymie FOIA, whether State's attempts to settle the case in late 2014 and early 2015 amounted to bad faith, and whether State's subsequent seraches have been adequate. The parties are to submit a proposed plan and schedule for discovery within ten days. Once discovery ends, the Court will determine the adequacy of the State's searches and set a further schedule for the submission of Vaugh affidavits and dispositive motions.

Awesome.

Could be interesting and present you with some psychological relief. Could also make it worse, who knows.

It does. It's clear that the Obama "Justice" Department acted politically in this situation. Largely because it appears that they not only knew about it and were caught up in it, but that Obama, himself, was caught up in it.

FOIA is actual, genuine liberalism at its finest. I think it should be revealed if politicians are taking dishonest actions to get around these important innovations in accountable governance.

Wow. District Court Judge Royce Lamberth ... a Texas native and lifelong Republican, Lamberth rose to the rank of Captain in the U.S. Army, then attended the University of Texas undergrad and law school, and was nominated to the federal bench by President Ronald Reagan.

And . . . wait for it . . . . Lamberth was the Presiding Judge on the FISA Court from 1995-2002.

HOWEVER . . . you'd have a hard time accusing him of being anti-Hillary:

Quote:
Hillary Clinton dismissed from 'Filegate' suit
July 16, 2009

Judge Royce C. Lamberth dismissed Hillary Rodham Clinton from a lawsuit filed in 1996. The case involved the Clinton White House’s handling of FBI background records when the Clinton Administration was under investigation for firing White House travel office employees.[3] White House staffers under Clinton acknowledged in an affidavit that they sought and received the FBI files of hundreds of prominent Republicans.

Attorneys who continued to pursue the case argued that the case should not be dismissed until Mrs. Clinton was called to testify. Judge Lamberth disagreed, stating: "There was no legal reason that we should require a busy cabinet secretary to submit to an oral deposition at this point.” Link
.

And you'd have a hard time proving he's pro-Trump or anti-Obama. Remember "The Birther Queen?

. . .
. . . . . . . Orly Taitz

Orly Taitz, aka The Birther Queen, is the conspiracy-crazed woman who - in addition to promoting nonsense conspiracy theories like Sandy Hook and FEMA concentration camps - was a tireless and vocal supporter of the "Birther Movement." She appeared in public with Donald Trump on several occasions, demanding Obama publicly admit he was born in Kenya. Well, Judge Royce C. Lamberth lowered the BOOM on her:

Quote:
Benchslap of the Day: Judge Rebukes "Birther Queen"
July 27, 2011

Tough words from Judge Royce C. Lamberth. From his order striking plaintiff Orly Taitz' response to motion for summary judgment:

"Wasting the Court’s time with nonsense is not the way for Ms. Taitz to have any hope of prevailing. After making the somewhat hysterical claim that there was 'an employee in this court who is intentionally sabotaging' her, she engaged the Court's Deputy Clerk in a lengthy, accusatory conversation.

Plaintiff is either toying with the Court or displaying her own stupidity. There is no logical explanation she can provide as to why she is now wasting the Court’s time, as well as the staff’s time, with these improper redactions.

Your link is broken ...

Doesn't matter where it was going, there is NO WAY Obama was involved in any fraudulent submissions for FISA warrants, or anything else for that matter, especially not in the last few months of a squeaky-clean two-term presidency.

In fact, during the last months of the 2016 campaign, Obama wrestled with whether to go public with intel on Russian election interference. He chose not to because he didn't want to seem like he was doing so to help Hillary Clinton ... the SAME REASON James Comey said nothing about the ongoing Trump investigation in the final months of the campaign ... and the SAME REASON Comey felt comfortable sending that infamous letter to Congress just 10 days before the election, informing them there was additional evidence in the Clinton e-mail investigation, remember that? There is a very solid argument that letter cost Hillary the election. These are facts, TJ ... so why you hatin' on Comey?

And I'm sorry to tell you, but the judge's ruling in this Hillary FISA case is not so scathing ... and not what you think it is. All he did was order the parties to come up with a discovery schedule, which is due in 10 days. Such an order has ZERO relevance to guilt or innocence.

. . . . . Judge Royce C. Lamberth

Having said all that, I must admit I really like this Judge Lamberth . . .

Just last week he HAMMERED an Internet porn company called "Strike 3":

Quote:
Pornographer 'Strike 3' engaging in High-Tech Shakedown, Judge Says
November 27, 2018

Plaintiff 'Strike 3 Holdings' claim they produce "critically acclaimed" pornographic material, and call themselves "The Steven Spielberg of Porn." A federal Judge calls them "Internet copyright trolls."

U.S. District Judge Royce C. Lamberth, in denying their motion for a subpoena, called Strike 3 one of the most litigious companies in the country: “Armed with hundreds of cut-and-pasted complaints and boilerplate discovery motions, Strike 3 floods this courthouse (and others around the country) with lawsuits smacking of extortion,” Lamberth wrote. “It treats this court not as a citadel of justice, but as an ATM. Its feigned desire for legal process masks what it really seeks: for the court to oversee a high-tech shakedown. This court declines.”

Lamberth's opinion denied Strike 3's request to subpoena customer records from an internet service provider in order to identity a defendant who allegedly stole dozens of "German Scat" pornographic movies from Strike 3. Plaintiff claimed that without the subpoena, the only information they had found were two of the user's alter egos, 'Darth R__' and "Schrute Farms.' They said investigations were stymied by the suspect's use of a "subnet mask" program that hides an Internet user's true identity.
. Link and Link ('Fox Rothschild' is their law firm.)

Very interesting ....

TACO, your thread title is wrong. The Court ordered more discover to determine WHETHER there was bad faith.

And that passage refers to the State Department, and by extension Hillary. NOT Obama.

Buff didn't say anything I didn't already know. He posted for his own sake, not mine.

I'm content to let the letter speak for itself and the process play out.
