Default OT: Speeding Ticket

Need some help guys. I got a speeding ticket the other day. Does anyone know the ins and outs and if its worth fighting and better yet can I win? Here is a breakdown of what happened.

Thursday 1:30 AM. Coming home from cleveland in my 2008 Red Mitsubishi Lancer on interstate 77S. Im driving, wife in passenger seat, my sister,her husband and my 2 year old in the back. (My 2 year old is in a car seat and is asleep). We are coming back from creed concert. A Ohio State Highway Patrol Officer is coming North on 77. There is absolutley no traffic in either direction. I dont know its him till he lights it up and pulls into the median behind me. I am going 75+ in a 65. I slow down, without hitting brake, to 65. he pulls me over. I roll down all the windows ( they are actually to dark for ohio which is 50% and they are 30%) and I turn on the dome lights and put my hands on the wheel. He comes up and asks for license. I give him the licnese. he said " where you coming from" I said creed concert. He said" do you know you were speeding?" I said "yes sir, I was going a little over the limit, Im sorry". He said he got me at 80 in 65 on radar coming the opposite way. I dont mind the ticket price 110.00, I just dont want points. what can I do? I was polite the entire time and never talked back to him.

Do they have a defensive driving program in Ohio? If so, do that and it'll kill the points.

It takes a lot of time and effort to fight a ticket. It's usually better just to suck it up and eat it unless you work from home and have a bunch of spare time during the weekdays.

Go to court. Usually you can plea guilty to a lesser charge and that will reduce points. And in some cases with that plea you can go to a defensive driving class and have even more points reduced. Thing is it does cost you more with fines, court costs & the driving school fee. IMO in the long run its worth it when you figure in insurance premiums, retaining your licence, etc...™

Just curious, but how would you plan on defending yourself if you were actually speeding? (and even got off easy without any tint citation...) You not knowing it was a state trooper coming the other way isn't a great argument

In all seriousness, I hope you can reduce the points/insurance hit

What is your prior record? If it is relatively clean and you attend driver improvement school BEFORE court, they may put you on probation. I have used this to get a couple reckless driving charges dismissed.

Here they usually won't pull you over for 10 over unless it's a slow time. The other problem is your car is red. They are a target, plus a sporty looking car. The defensive driving course is your best bet as others have said. It does knock the points down.

You're probably boned. In washington they have been assraping everyone with tickets, they don't even hear your case, maybe 30 seconds for them to say "Next" and you pay the full price.

State governments are broke as **** right now and they're going to slam the **** out of the middle-class until they catch back up.

I just reread and saw the end where you admitted to speeding to the officer. You're boned.

NEVER say anything when you get pulled over people! If they say "Did you know you were speeding?" Say "No." That's all you have to say and you're not guaranteed to take it in the ass.

Exactly.

If they have one of those driving classes like JCM mentioned, your best bet is to probably do that. Here in Florida it lowers the cost of the ticket, no points, and under state law your insurance cannot be raised.

You can take your chances in court, but personally I'd just take the class and be done with it.

Slow time and color had nothing to do with it, SP was out looking for drunk drivers.

Contact a lawyer and see if you can get it knocked down to parking on pavement or something with minimal points because there's no way you're gonna beat it totally.

Im just saying about the trooper thing, is I would have slowed down. No way am I using that as an argument. Im just wondering about radar and how reliable they are in a moving patrol car coming opposite directin? Is it true that If i show up and he doesnt, then the ticket get kicked out of court? I can afford the ticket, just dont really want it on my driving record. Already have a accident from when my wife hit a deer 3 months ago

The cop never told me it was reckless driving. Is that for only over 15? cause I was 15 right on the money. They set it up for 2 weeks from now for court or pay.

In Colorado if your record is relatively clean, it's almost automatic that they'll offer a 1 point defective vehicle or something along those lines without the expense of a lawyer for a minor violation like that.
