Im sorry for posting this here but my internet access is limited & i work 10 - 12 hour days so this is one of my last options.
I was pulled over for speeding, going 50mph in a 25mph school zone. The regular speed limit there is 45mph, plus i was going down hill. Anyways i was jus wondering if i should get a lawyer? If you have any other advice please let me know thanks. |

You can go to court and hope the officer won't show to explain the violation. They usually throw it out. I wouldn't pay for an attorney. If your wrong face the judgement and chalk it up as alesson learned.

Lawyer? Only if you where pulled over during non-school hours. But if it was during school hours you are going to have to pay the ticket. |

If your driving record is clean, then sometimes you can defer the ticket.... or ask for a mitigation hearing. Then again, by going to court, you might lose enough $$ (due to missing work) that just paying the fine might be simplest. Plus, the fact that it was in a school zone might make them less willing to negotiate....

Double the speed limit in a school zone could be grounds for reckless driving ticket. Thats an 8 pointer. I am sure you are required to show up due to the speed and the zone. If you have a clean record they will often offer you a reduced fine and point total if you pay right there.
I wouldn't recommend a lawyer unless you are facing the loss of your license and losing your job. But what were you doing going 50 in a school zone. Kids are retards and you could have ended up in a lot worse shape. Sorry for the lecture, stepping off my soap box. |

The lawyer will cost as much or more than the fine. Unless you are facing jail/loss of license, I wouldn't contest it. Just pay it, particularly if you knew you were over the speed limit to start with. The "everybody does it" defense doesn't play well with me.
I once sat on a jury where a guy was being prosecuted for speeding. The defense attorney let the defendant get on the stand to refute the cop with the radar gun. The prosecutor was clever. "You say you were going 30 and you're sure of it. How can you be sure?," asked the prosecutor. "I know how fast I was going. I've been driving for 30 years," he said. "So you'd consider yourself an expert on proper driving speed?", she asked. "Yes, I know how fast I was going," he answered. "Well," she said, "since the defendant has proclaimed himself an expert in this field, Your Honor, let me introduce into evidence these records of past moving violations on the part of the defendant..." It's illegal to bring up prior convictions but there are exceptions to the law and this prosecutor set the trap expertly and got the defendant to label himself an expert, thus calling into question his credibility on the subject of safe driving - thus allowing his past convictions to be entered into evidence and making it clear to us jurors that the defendant was fighting the ticket because he'd lose his license if he was found guilty. We nailed the bastard. |

at first I was pissed off myself , untill I picked up the 45 mph zone , tells me it is highschool area , I know still kids , but it isnt like speeding in a elementary school zone , so I cut him some slack . if he is lucky the judge will also

I know that , but I was talking about Elem. Schools in that high of a speed zone , even in New York city they try to keep elem . Schools far from main throughfares

First ticket in 3 years? You can go to traffic school and have it removed. Otherwise, if you don't have many tickets, you can often times show up to court, say you are sorry, you can't afford the full amount and they will often times reduce it or give you a payment plan. Just depends, though. Most often times they cop has the time set aside and all of those who he wrote tickets to are set up for the same time frame and he has it scheduled for him to be there. Don't necessarily count on him not showing as that doesn't happen often any longer.
Bottom line, if you choose to speed, you choose to get a ticket IF you get caught. A lawyer really can't do anything about it. |
