Default Reckless Driving - Virginia

I was issued a Reckless Driving Ticket for doing 83 in a 55. It's my fault for not knowing the speed limit and going with the flow of traffic.

Should I look at getting a lawyer? I'm pretty scared ****less of the possibilities that can happen to me. This is my first ticket, but i don't know if it'll make a difference.

Find a car repair shop that will do a repair order on a broken odometer and bring it to court. You should end up with a much smaller fine and no strikes against your driving record.

Not exactly...if he was just doing 20 over 55...that would be one thing...but 80 plus is automatic reckless and you are given the option of a lawyer. Even if it's reduced 5 miles...which is all you are going to get out of a "broken odometer" it's still reckless.

Call the clerk....ask if you can request Driving school on your situation. the number is on the summons the officer gave you.

Come on, you know the cop was ****ing with him. Ratboy seems as if he pissed his pants. The cop can talk all the ying/yang he wants about "reckless driving", but since Ratboy has never even had a ticket before and serves in the arm forces, I don't see a judge denying his broken odometer claim.

Plus he is a kid. They ain't ****in' with him unless he really was driving recklessly -- i.e. running over sidewalks, crossing eight cars at one, etc....

No it really doesn't, but a lawyer would be able to better answer that.

In Virginia, most judges will let you take driving school for a first offense in the Commonwealth. I would call the clerk first to see what they say. Other wise I would do what Gonozo says and get a lawyer.

In the state of Virginia, 80 plus or twenty over is an automatic reckless driving ticket. The term "reckless" is arbitrary. At best he could get it reduced to an improper equipment conviction, but that is totally up to the judge. Even still, unless is odom is off by 8-10 miles...it's still reckless because it was in a 55 MPH zone.

Yea, he still might end up with a speeding ticket, but nothing like he was facing before (reckless driving).

We'll...call the clerk...then go see legal representation. I'm not familar with Hampton courts so I don't know what the judges will do. I don't think they would hold you off you TSC regardless, but you never know. But relax.....and watch your speed.

Unless you were smoking crack and being manually stimulated by a yak, then this should not effect your clearance. You can either take one of those online driving classes (that is what my wife did in the same situation) or just throw yourself on the mercy of the court (if you have a clean record, then it shouldn't be that bad). The worse thing they can do is suspend your license for 6 months (which happened to my wife but she had a ton of tickets).

When driving in VA, don't go over 70 in a 55 and you should be okay.....

you done screwed up ........... probably sped in a work zone .......... Damn lucky your ass isnt in jail, Reckless is a heavy charge ........
what ever you do dont tell the judge you wasnt paying attention and just flowing with traffic ...........
i would go see the DA first , strike a deal, if a deal cant be made get a lawyer .As gonzo said , get a speedo repair ticket , that will cover about 7 mPH of that 83 , and yes that makes a difference ...........
Chances are you will walk away with Careless or even speeding

"You should always contest a reckless driving charge. If there were no other issues during the stop most Virginia courts will reduce the violation to a simple speeding ticket. However this still carries a stiff point count with the possibility of a major increase in you auto insurance and a fine in the neighborhood of $500."

I'll have to find a lawyer. It's not something i can just show up for.

See here in Wyoming we are not on a point system ........ 4 major moving Violations in a year , your lic. will be revoked

Not just a reckless driving charge, I'd contest every traffic charge that comes your way, even if you're blatently at fault...hey, it's your insurance rate that hangs in the balance. I know they're illegal in VA as well, but screw that crap and get a radar detector....be discreet when using it there in the People's Republic of VA though (ie. don't hang the thing from your visor) or they'll be on you in a heartbeat. Be cool about it.

Sure it was written in 1990, but much of it's info is still valid...case in point, I got the book in '93 and I've successfully avoided/talked my way out of every pullover since....picking it up used for a buck something could help in preventing future situations like this...what do you have to lose?

In alot of States 80mph+ isnt reckless , at most you get a careless ....
Except for turnpikes , they are under a slightly different law , you can still get busted for speeding , but I dont remember the difference ...............
if I was in my Rig and got caught for 80mph+ in a 55 , my ass is in jail , no questions asked in any state , most troopers cut you a break ( depending on where you are , time of Day , road conditions etc) ...........
