The Family Smoking Prevention and Tobacco Control Act (6/22/09) gives the FDA the power to regulate what kind of advertising the tobacco industry can have on the premise that use of tobacco is harmful to your health. I would be in favor of Congress passing legislation banning or severely restricting advertisement of any kind for specific types of prescription medication, on the basis that telling patients to "ask your doctor if X is right for you" puts undue stress on doctors whose patients attempt to self-diagnose prior to visiting the doctor.
Doctors are big boys and girls. I doubt any feel undue pressure because of a lunesta commercial. I get it though you want regulations everywhere. You think you can legislate the F out of U.
