View Full Version : Malpractice Reform...Convenient Timing

Now that the government is taking over the health care sector, they want to limit the peoples' right to sue them over malpractice.

Sounds like theyre not too confident in their ability to provide health care.

Not for nothin' but obamacare actually increased the # of people who will be on private insurance, not medicare. I know - crazy huh. Obamacare sucked in general but at least it was an attempt. I looked at my W2's I just received today. I spent over 7500 bucks on insurance - and it went up another 2600 this year. If that isn't some **** that needs to be fixed, I don't know what is. Once again, rich get richer bc with insurance, food, gas, oil, heat for house all going up greater than any cost of living raise - the middle class is becoming a novelty - a thing of the past. While the rich keep getting their tax cuts and holding on to their money, the middle class is slowly dying. Medical care is probably the biggest thing causing this. So at least someone is trying something. Better than what GW 2 did in his 8 years

I am dating an actual doctor ( who would have thought a smart woman would date me ;D) she is for Obama care , last night at red lobster , she went on and on bout mumbo jumbo legal stuff , in the end more people on Ins , the more docs get paid ...... And she is no lib by any means .......

The current state of malpractice in states without caps is a total disaster.

In states with caps people who suffer from malpractice get totally screwed, insurance premiums are only slightly lower than in states without, but physicians can at least begin to undo some of the inane defensive practices that have been built up into the "standard of care"

Basically we need an entirely new system of trying malpractice cases - but that would be difficult. Caps provide an expedient, easy way out for politicians while making insurance companies plenty of money and perhaps very modestly reducing the costs of defensive medicine(which likely accounts for only a very small piece of the total health care pie).

LOL I assume you were too busy eating those biscuits to pay attention to what she was saying.

When I was divorced i once made the mistake of taking a lady to Red Lobster. Between those biscuits and the king crab legs, the conversation I had with her contained an mmhmm, a yeah, then nod, then repeat. Needless to say a second date was out of the question.;D

They even offered it up as a alternative to HCR. You don't remember John Boehner comming out saying the "CBO" projects we can save 54 billion over the next ten yrs by limiting what people can sue for.

hell texas has some some of the most strictest tort reform laws in the country...I'm sorry, let me put this in terms you can understand, texas has some of the strictest laws limiting what people can sue for over malpractice.

It is worth noting specifically that Texas simply caps pain and suffering awards - $250k. Loss of income, economic damages, future medical costs can all be recouped.

This law is nothing compared to government run health care. Hell, there isn't even a public option for national health care.

Let me ask you, how would you sue the government with Obamacare? Provide an example where the government is "providing health care?"

Don't get me wrong... I think Obamacare is full of holes and will be contested by Americans for years to come; but a government take over it's not.

I work in a law office I don't like it! Wait until your kid gets his arms amputated over a botched operation, then them tell you you can only get 1 million dollars and it has to last yr kid for like. I'm not for frivolous lawsuits but putting a cap on damages when damages could be way above that screws people who are the most damaged.

tort payouts are such a small percentage. It's the premiums. So unless this is tied to reducing premiums; It's pointless.
