After operating largely under the radar during his first few months in office, Al Franken is beginning to make political ripples.
On Tuesday night, he got his first piece of legislation passed by the Senate via roll call vote. The amendment stopped federal funding
for those defense contractors who used mandatory arbitration clauses to deny victims of assault the right to bring their case to court.
It passed by a 68-30 margin with nine Republicans joining each voting Democrat. And in the immediate aftermath, Franken was
granted the chance to revel, ever so slightly, in his victory.
"The story came to my attention of Jamie Leigh Jones who, when she was 19, went to Iraq to work for Chenery's KBR and she was
put in the barracks with 400 men and was sexually harassed," Franken said after the vote. "She complained. But they didn't do anything
about it. She was drugged and gang raped and they locked her up in a shipping container. She tried to sue KBR and they said you have
a mandatory arbitration clause in your contract. She tried to fight back and said this is ridiculous. She took it to court and they
have been fighting her for three years."
"This bill would make it so that anybody in business with the Department of the Defense can't do this," he concluded emphatically.
"They can't have mandatory arbitration on issues like assault and battery."

Oh my, I'm about to faint. Just got this message from Sarah Palin.
Dear RapeFan,
I'm happy to say that I'm a fan of you! I was delighted to see mention of my rape legacy in the great state of Alaska. It really warms my heart to know that there are people out there who appreciate my work.
However, I want to make one thing clear. I do not and never have supported government intervention in rape. Not by the police, and not by doctors. My record on this is clear. Back when I was mayor of Wasilla, I made sure that we didn't spend one government cent on rape. Yeah, that whackjob who just got a loophole closed that disallowed rape victims to sue their attackers. Seems to me Franken is far more sane than the 30 Republican Senators who voted against the measure (or, at the very least, more sound morally).

I had things ass backwards. I don't care for Franken, but support this measure. People need to be held accountable at all times. Regardless of the company they work for!

Looks like the military/industrial complex found the stooge they were looking for in Inouye to dismantle this bill. Freedom from responsibility marches on. We can all be proud:
"The defense contractors have been storming his office," said a source with knowledge of the situation. "Inouye either will get the amendment taken out altogether, or water it down significantly. If they water it down, they will take out the Title VII claims. This means that in discrimination cases, they will still force you into a secret forced arbitration on KBR's (or other contractors') own terms -- with your chances of prevailing practically zero. The House seems to be very supportive of the original Franken amendment and all in line, but their hands are tied since it originated in the Senate. And since Inouye runs the show on this bill, he can easily take it out to get Republicans and the defense contractors off his back, which looks increasingly likely."

HOUSTON — A woman who claimed she was raped in 2005 while working in Iraq for a former Halliburton Co. subsidiary has been awarded nearly $3 million by an arbitrator to settle her case.
Tracy Barker had sued U.S. contractor KBR Inc., its former parent company Halliburton and several affiliates in May 2007, claiming she was sexually attacked by a State Department employee while working as a civilian contractor in the southern Iraqi city of Basra.
A federal judge in Houston had dismissed Barker's lawsuit in January 2008, ruling she had to abide by an employment agreement she signed that said any claims she made against the companies would have to be settled through arbitration and not the courts.
Court records filed this week show Barker was awarded a judgment of $2.93 million to settle her arbitration claim against KBR.
