Need some help guys. I got a speeding ticket the other day. Does anyone know the ins and outs and if its worth fighting and better yet can I win? Here is a breakdown of what happened.

Thursday 1:30 AM. Coming home from cleveland in my 2008 Red Mitsubishi Lancer on interstate 77S. Im driving, wife in passenger seat, my sister,her husband and my 2 year old in the back. (My 2 year old is in a car seat and is asleep). We are coming back from creed concert. A Ohio State Highway Patrol Officer is coming North on 77. There is absolutley no traffic in either direction. I dont know its him till he lights it up and pulls into the median behind me. I am going 75+ in a 65. I slow down, without hitting brake, to 65. he pulls me over. I roll down all the windows ( they are actually to dark for ohio which is 50% and they are 30%) and I turn on the dome lights and put my hands on the wheel. He comes up and asks for license. I give him the licnese. he said " where you coming from" I said creed concert. He said" do you know you were speeding?" I said "yes sir, I was going a little over the limit, Im sorry". He said he got me at 80 in 65 on radar coming the opposite way. I dont mind the ticket price 110.00, I just dont want points. what can I do? I was polite the entire time and never talked back to him.

Do they have a defensive driving program in Ohio? If so, do that and it'll kill the points.

It takes a lot of time and effort to fight a ticket. It's usually better just to suck it up and eat it unless you work from home and have a bunch of spare time during the weekdays.

Go to court. Usually you can plea guilty to a lesser charge and that will reduce points. And in some cases with that plea you can go to a defensive driving class and have even more points reduced. Thing is it does cost you more with fines, court costs & the driving school fee. IMO in the long run its worth it when you figure in insurance premiums, retaining your licence, etc...™

Just curious, but how would you plan on defending yourself if you were actually speeding? (and even got off easy without any tint citation...) You not knowing it was a state trooper coming the other way isn't a great argument :P

What is your prior record? If it is relatively clean and you attend driver improvement school BEFORE court, they may put you on probation. I have used this to get a couple reckless driving charges dismissed.

Here they usually won't pull you over for 10 over unless it's a slow time. The other problem is your car is red. They are a target, plus a sporty looking car. The defensive driving course is your best bet as others have said. It does knock the points down.

State governments are broke as **** right now and they're going to slam the **** out of the middle-class until they catch back up.

NEVER say anything when you get pulled over people! If they say "Did you know you were speeding?" Say "No." That's all you have to say and you're not guaranteed to take it in the ass.

Exactly.

If they have one of those driving classes like JCM mentioned, your best bet is to probably do that. Here in Florida it lowers the cost of the ticket, no points, and under state law your insurance cannot be raised.

You can take your chances in court, but personally I'd just take the class and be done with it.

Slow time and color had nothing to do with it, SP was out looking for drunk drivers.

Contact a lawyer and see if you can get it knocked down to parking on pavement or something with minimal points because there's no way you're gonna beat it totally.

It takes a lot of time and effort to fight a ticket. It's usually better just to suck it up and eat it unless you work from home and have a bunch of spare time during the weekdays.

Actually, I am at home during the day. Going to college at night!

Im just saying about the trooper thing, is I would have slowed down. No way am I using that as an argument. Im just wondering about radar and how reliable they are in a moving patrol car coming opposite directin? Is it true that If i show up and he doesnt, then the ticket get kicked out of court? I can afford the ticket, just dont really want it on my driving record. Already have a accident from when my wife hit a deer 3 months ago

The cop never told me it was reckless driving. Is that for only over 15? cause I was 15 right on the money. They set it up for 2 weeks from now for court or pay.

In Colorado if your record is relatively clean, it's almost automatic that they'll offer a 1 point defective vehicle or something along those lines without the expense of a lawyer for a minor violation like that.

Holy ****. I never thought about that. You know whats really funny? ok kinda funny, is that on the way to the concert we were stuck in traffic for the show. There were 2 cops directing traffic and they let everyone in my lane go, and then stopped me. I used the "man, I would bust a cap in his ass" line from super troopers. Maybe it was karma.

JK. It was outdoors at an amphitheater and we had lawn tickets. the weather was perfect and he likes music. He danced the night away. He never even fell asleep until we got back into the car for triphome. He loved it.

BTW What is up with all the creed haters? The concert rocked. It was my 4th creed concert. Ok, 3rd creed cause 1 was scott stapp when he was solo. The concert had hoobastank as pregame warmup. Creed rocks (and the tickets were only 10.00 a piece with no ticketmaster charges)!!

Im not even a religous person> I just love the music. We did smell pot a few times. But it WAS OUTDOORS. and there was security everywhere. I also took him to an outdoor maroon5/counting crows concert. i take my boys everywhere.

Absolutely. Cops can get in alot of trouble for ignoring subpoenas and blowing off court, plus they get overtime, usually 4 hours worth. It's rather rare for a cop to not show up for court, plus the courts are always willing to work around their schedules.

And with a trooper, they probably would be more vigilant since they live and die off traffic citations. They take that stuff pretty seriously where a city/county police officer might not.

If they have that driving course that keeps the points off his license that would be the smart move as it's a sure thing.

That's absolutely true. Citations are "cost effective" revenue streams that they rely upon for the upkeep of their equipment. They actually lowered the BAC level in NY because the high compliance rate was affecting the state police's bottom line.

One of the many reasons I'm not a fan of state police/highway patrol.

Don't know much about Colorado Highway Patrol, but I don't imagine they're going to blow off tickets that they write either. Not much logic to that.

They show up for infractions, that's about it. If it's the more serious stuff (DUIs, Vehicular Assaults, HTO offenses), things that would go in front of a judge and jury if it went to trial and not a magistrate, they're incredibly tough to work with.

No. In Virginia 20 over is reckless driving. Just used that as an example of two clients I recently had where going to driver improvement school helped. Got one dropped by the cop and the other reduced to improper equipment. You usually can't just pay a reckless driving. If you have a decent record, go to driver improvement school before court, maybe get your speedometer calibrated, you could well get your finding withheld pending a period of probation.

I got a speeding ticket from an HP going 80 in a 65 and was only fined $55.

Keep taking the 2 year old to concerts and watch how quickly he has no hearing when he's an adult. (And before someone says it, this is not a Creed-related joke......though it would make a good one) Concerts can do SERIOUS damage to someone that age.

I got one of those BS photo radar tickets here in AZ for speeding and let me tell you what a joke they are. Expensive compared to other tickets and this stupid state says serving tickets in the mail is a legal method.

What the hell r u talking about genius? read the entire article before you post. both were in summer, OUTDOORS and we sat in the grass so far away from the stage we could barely make out who was on stage. Listening to my surround sound is louder. jeesh.

You were speeding 10 + over the limit, act like a man and pay the ticket. Jesus. If you don't want tickets on your driving record, don't break the traffic laws.

1. What does it being the summer have to do with the decibel level?

2. Outdoors? Same thing. I've been to plenty of outdoor venues that have speakers in more places than just the stage.

Way to make a huge jump there. How can you possibly go from "advising against going to concerts" to "locking kids in a closet"? That leap really makes no sense.

There's a difference between locking kids in a closet and taking a freaking 2 year old to a rock concert......something that their doctors will most certainly advise you against.

But, I would rather admit that I sped than going to a Creed concert. This will be used against you in a court of law!!!!! I have been pulled over 4 times with receiving a ticket since 2002 and won every one of them. How? When the officer is ready to go back to his vehicle, I ask if he is going to write me up for a ticket. He said, "Yes", so I told him I want county court. Now, not sure how it works in your state, but in California, we have the option to go to our county courthouse instead of the local jurisdiction that the officer frequents on a daily/weekly basis. This, I guess, helps for a more fair verdict as the officer is not known at an outside courthouse. The dates and times are different than his schedule and with me being the only ticket for him to fight, he doesnt show. 4 out of 4 times is 100%. Got my bail money back from the tickets, no points and no traffic school! Find out if this applies to your state and use it at will. Of course, if you get a ticket in an area like LoDo, you are probably scheduled to go to the county courthouse anyways but if that courthouse is 40 miles away, you can bank on the officer not showing.

This, I guess, helps for a more fair verdict as the officer is not known at an outside courthouse. The dates and times are different than his schedule and with me being the only ticket for him to fight, he doesnt show. 4 out of 4 times is 100%. Got my bail money back from the tickets, no points and no traffic school! Find out if this applies to your state and use it at will. Of course, if you get a ticket in an area like LoDo, you are probably scheduled to go to the county courthouse anyways but if that courthouse is 40 miles away, you can bank on the officer not showing.

Thanks. That makes alot of sense. I will check into it today. I acutally receieved a letter today from the place i was suposed to go to court for it and it said the judge is out of town that week and they moved it back from the 10th to the 17th. Thanks again.

Way to make a huge jump there. How can you possibly go from "advising against going to concerts" to "locking kids in a closet"? That leap really makes no sense.

There's a difference between locking kids in a closet and taking a freaking 2 year old to a rock concert......something that their doctors will most certainly advise you against.

TRUST ME, nobody in the USA has any right to complain when they receive a speeding fine!
Australia is a fascist state, where they'll mail you your speeding fine. My last one, after they rounded it down to allow for (possibly) faulty equipment, the fine was for "speeding" a massive TWO miles (3km/h) over the limit.

To bag on Creed but then be a disciple of same lame grunge rock band is pretty funny. At least Creed knew how to write a hook and make a melody.
