Analyst: Burress 'deathly afraid' of jail time, not listening to lawyers

Plaxico Burress may be rejecting the advice of his lawyers to take the best deal on the table for the weapons charges he faces. The problem, Giants radio voice Bob Papa said on Sirius satellite radio, is that Burress is "deathly afraid" of going to jail.

Papa, also the play-by-play voice of the NFL Network and a host on Sirius radio, points out that if Burress had accepted the deal with about two months jail time served in early April, he would be close to getting out -- and free to seek a new NFL job.

From Papa (thanks to PFT for getting the transcript):

"They worked out something where they had it down to about a three-month jail term with actually only two months served and about 1,500 hours of community service. And I think his lawyers felt that they had a pretty good deal. He doesn’t want to go to jail at all. He shot down the deal. ... He does not want to go to jail at all. So now coming up in another couple of weeks we’re gonna find out what’s gonna happen. But my guess is that the city of New York is not gonna back off any kind of jail time.

“Evidently, he’s gonna have to go to Ryker’s Island. He’s deathly afraid of going. ... (I)f he would have just taken the deal when it originally was offered it would all be over with by now. But supposedly the community service hours and the jail time are not appealing to him. He does not understand that he is not in any kind of position of leverage. He has no leverage. He — not his representatives — he thinks he has leverage.”


There are huge consequences for Burress, who faces 3-1/2 years in jail if he goes to trial on the weapons charges. And the longer the legal issues hang above him, the less likely he is to sign on with a new NFL team.

Everyone should be afraid of jail ....... that's why it's a punishment.

So he isnt scared to carry a loaded gun around but is afraid to sit in a jail cell for 3 months? lol

He shouldn't be going to jail anyway. He should be laughed at for his million dollar wound, but possessing a fire arm should not put him in jail. The 2nd Amendment has no conditions to bare arms.

Agreed. It doesn't say "the right to bear arms if you pass certian tests and are deemed ok to carry one."

Amendment II

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed
people seem to forget the 1st part.

He is techinically in a militia provided he registered for Selective Services when he turned 18. One definition of a militia is:

The entire able-bodied population of a community, town, county, or state, available to be called to arms.

That is exactly what the founders were contemplating as they just fought the revolutionary war with exactly that type of militia.

quite frankly, i'd be more concerned about a person that ISN'T afraid to go to jail...
