Authorities recently executed search warrants at two private homes in Columbia, S.C., and arrested eight people for marijuana possession, in connection with an investigation into the photo of Olympic swimmer Michael Phelps holding a bong, ABC News has learned.


Armed Richland County Sheriff's Department officers entered at least one of the properties Saturday, Feb. 7, sources told ABC News.

Though eight people were arrested, less than an ounce of marijuana was confiscated by sheriff's deputies, the sources said.


One of the properties was identified by the sheriff's department as a location where marijuana was "frequently stored and consumed," according to the search warrant affidavit, which also said police searched trash from the property that had been left by the road for collection.

Sgt. M.A. Poole of the Richland County Sheriff's Department appeared before a judge Feb. 6 to request the search warrants.

Sheriff's spokesman Lt. Chris Cowan would not confirm the arrests, but said there is an ongoing investigation into whether Phelps or others broke the law during a party -- allegedly held in November 2008 -- where Phelps was photographed with a bong in his hands.

Property taken during one of the raids included computers, marijuana -- including a partially smoked joint -- a bong, a cell phone, a portable drive and a camera, according to the sheriff's inventory from the search.





You have got to be kidding me!!!!!. Smoking marijuana is a misdemeanor there is no reason for search warrants. I almost can't believe a police dept would care enough about college kids smoking weed to go this far.

This police dept should be humiliated considering the area they police has real crimes like a murder they haven't solved and a rash of ATM robberies.

I'm not sure which knucklehead makes the decision to go in and do things like this, but this is clearly acting in opposition to the will of the populace at large. In America today, any trivial action like this that could be considered an excessive action coupled with a waste of resources will be looked on with contempt, and rightly so.

If a federal election was held today to legalize recreational marijuana use, it would be legalized wholesale. I have not doubt about that. People get upset at the police in these regards because they are the enforcing arm of a tyrant considering this issue.

The police officers get the brunt of the disdain because they are the face of the monster. They are the enforcement arm of the out-of-touch governance.

Maybe the police should boycott the arrest or citation of any adult in posession of marijuana.

LOL no doubt. Not to mention our President admits to doing it. That doesn't mean we should condone it but to execute a search warrant to catch some young men or women smoking pot seems excessive and I don't want to live in a world like that.

IMO this type of thing is so far more dangerous to our freedoms then the stupid Patriot act which basically doesn't affect anyone.

Sending in people with guns to get a bong and a blintz is just silly. There is a chance someone could get killed over nothing.

Go try and solve some real crimes. Maybe cops just getting a little pussified and don't want to go after the real criminals.

Do some old fashioned police work like send a snitch in to try and buy some weed. Watch the place and see what kind of traffic goes in and out. Follow a couple cars that leave the place and pull them over after its been 20 minutes or so since they left house. Say it's for not using turn signal, whatever, search car and see if they just bought drugs.

I'm not a cop but i work with attys, i interview cops all the time, that's how a good dept would look into something. They don't just get a warrant and barge in because some people smoked a bong and took a picture of it.

Or you really a cop you should know these types of things.

It was a PR thing done by SC law enforcement. I know law enforcement in SC, and in many places its a downright joke. "We aint gonna let you pantywastes come into our state, smoke drugs, and party."

That's exactly it. As a police officer you have a duty to enforce the law and follow any orders given to you unless that order itself is against the law.

If you don't like the law, take it up with your congressman, not the police force.

Im drinking lol. The BEST part about being american is IF as citizens we REALLY REALLY want a law changed we can do it. While I agree that the system spends way to much money on keeping pot illegal, the people that go about wanting it legal are not doing things right.

That said Phelps could become what Magic Johnson was to HIV if people play this right.

pretty much every poor choice I ever made in my life has been when I have been drinking. I can't ever say I made one poor choice while being high. While that doesn't make being high better then being drunk I have done both enough to know that if anything the wrong one is against the law.

have you taken a government class? Like it or not cops have to follow a set of LAWS put into place by people you vote for. While its true some cops do get away with **** not all are like that. I have ran into way more ****ty cops then good but at the sametime I know what I was doing was just enough to get the ****ING cop to look my way.
Man there are thousands of books on criminals and there thinking. Its a trip to read about someone that is in jail for grand theft auto talking to a loved one about his car that got stolen while he was in jail.

ok i understand all that about following orders as a cop. but on a personal level, don't you feel that the actions taken were a bit extreme considering it was just some college kids smoking weed?

And in case you missed the legalize pot thread, I wouldn't be against the decriminalization/legalization of it if some basic concessions were made, but until that happens its still an illegal drug.

Again, most cops I know wouldn't have touched that search warrant with a 10 foot pole unless it came from the Attorney General's office. Either way the people of that state or county should be furious at money ill spent, especially in this economy. But then again, those stoneheads can be a scary bunch, terroristic at times.

Seriously, if this happened in MA, thousands of dollars in taxpayer money would've just netted a maximum of a $100 ticket to the homeowner. Nothing more.

Once the pic went public, you can bet the homeowners would have the common sense to clean out anything that MIGHT have been left over in the house. The only chance the cops had at actually finding anything at all would've been to do the raid BEFORE the pics became public.....and they would know this.

That's exactly it. As a police officer you have a duty to enforce the law and follow any orders given to you unless that order itself is against the law.

If you don't like the law, take it up with your congressman, not the police force.

Public discussion is the first step when it comes to changing how the police operate. Enough citizens in that area get pissed off and that chief won't be chief anymore. Then the new chief tells his cops we won't be raiding homes for weed smoking anymore etc.

Why is it when it comes to police you feel there shouldn't even be a discussion?

Are police in your opinion above regular citizens? Oh wait they are to you. You were the one that said you think police are more honest then any other profession.

since Cops are more law abiding then regular citizens, and more honest, I think we should make cops do triple the punishment for any crime they commit. Would you support that law?

I was in the military, I didn't know how long i'd be in when i signed up. But i was forced to be in for at least 5 years, per my contract.. I got there, took a look around, found out what my leaders were all about and i said 'See Ya' the first chance i got. That is what you do when you don't agree with the values of the people you work for, you don't hide behind a badge or a chevron the rest of your life..

This is despicable. Every day i get closer and closer to leaving this country.. It's still a few years away, but it's getting closer and i will never come back for more than a visit..

Actually it technically is. Denver PD is required to enforce the laws of the State and in the State of Colorado it is illegal (although a misdemeanor under 1 oz). Stupid, but you can still get busted for it in Denver.

Florida's lack of comon sense is why people hate cops. The law is the law regardless of its stupidity. Some cops would enforce a law even if it actually injures another human being, but the law is the law damit.

Where I live the Sherrif is a die hard liberitarian and simply ignors marijuana type crimes unless it is compounded with another crime. Works well for him.

If you really believe that cops should turn a blind eye to something that is against the law something they are paid to do then you need help. Is the law a good law? I don't believe so. Does america spend way to much time and money trying to keep pot illegal? I would say yes. I don't smoke pot. I have and its just not something I would want to do every day even if it was legal.
The point is the government is set up for WE the PEOPLE to change laws if we don't agree with them. The thing is laws have been put into place and later changed because people went about it the proper way to get them changed.

I won't go into depth on this, but stating We the People shows your lack of knowledge on the history of our country. We the People doesn't have any legal significance now as that phrase doesn't exist in the body of the Constitution, rather the Declaration of Independence. Also, we aren't a true democracy; therefore, we the people have very little power to affect change. Citizen driven Constitutional amendments on a national level are extremely difficult to achieve, which is why our founding fathers originally gave most authority over citizens to state and local governments. I won't go into depth on how or why, but that authority has been taken by the Federal government.

So, yes I do believe that a Sherriff who is locally elected by a constituency which knows his stance on the war on drugs should be able to turn a blind eye to those type of incidences because his constituency has spoken loud and clear that this is what they want from him. Isn't that really We the People speaking?

Denver is another great example. The local we the people have said they don't want people punished for Marijuana use, yet the State and Feds say they have to, so what good was the voice of We the People?<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p>
