MIAMI, Florida (CNN) -- For 11 years, Pedro Zapeta, an illegal immigrant from Guatemala, lived his version of the American dream in Stuart, Florida: washing dishes and living frugally to bring money back to his home country.
Two years ago, Zapeta was ready to return to Guatemala, so he carried a duffel bag filled with $59,000 -- all the cash he had scrimped and saved over the years -- to the Fort Lauderdale-Hollywood International Airport.
But when Zapeta tried to go through airport security, an officer spotted the money in the bag and called U.S. customs officials.
"They asked me how much money I had," Zapeta recalled, speaking to CNN in Spanish.
He told the customs officials $59,000. At that point, U.S. customs seized his money, setting off a two-year struggle for Zapeta to get it back. Zapeta describes how he lost his money »
Zapeta, who speaks no English, said he didn't know he was running afoul of U.S. law by failing to declare he was carrying more than $10,000 with him. Anyone entering or leaving the country with more than $10,000 has to fill out a one-page form declaring the money to U.S. customs.
Officials initially accused Zapeta of being a courier for the drug trade, but they dropped the allegation once he produced pay stubs from restaurants where he had worked. Zapeta earned $5.50 an hour at most of the places where he washed dishes. When he learned to do more, he got a 25-cent raise.
After customs officials seized the money, they turned Zapeta over to the Immigration and Naturalization Service. The INS released him but began deportation proceedings. For two years, Zapeta has had two attorneys working pro bono: one on his immigration case, the other trying to get his money back.
"They are treating me like a criminal when all I am is a working man," he said.
Zapeta's story became public last year on CNN and in The Palm Beach Post newspaper, prompting well-wishers to give him nearly $10,000 -- money that now sits in a trust.
Robert Gershman,one of Zapeta's attorneys, said federal prosecutors later offered his client a deal: He could take $10,000 of the original cash seized, plus $9,000 in donations as long as he didn't talk publicly and left the country immediately.
Zapeta said, "No." He wanted all his money. He'd earned it, he said.
Now, according to Gershman, the Internal Revenue Service wants access to the donated cash to cover taxes on the donations and on the money Zapeta made as a dishwasher. Zapeta admits he never paid taxes.
CNN contacted the U.S. Attorneys office in Miami, U.S. Customs and the IRS about Zapeta's case. They all declined to comment.
Marisol Zequeira, an immigration lawyer, said illegal immigrants such as Zapeta have few options when dealing with the U.S. government.
"When you are poor, uneducated and illegal, your avenues are cut," he said.
On Wednesday, Zapeta went to immigration court and got more bad news. The judge gave the dishwasher until the end of January to leave the country on his own. He's unlikely to see a penny of his money.
"I am desperate," Zapeta said. "I no longer feel good about this country."
Zapeta said his goal in coming to the United States was to make enough money to buy land in his mountain village and build a home for his mother and sisters. He sent no money back to Guatemala over the years, he said, and planned to bring it all home at once.
At Wednesday's hearing, Zapeta was given official status in the United States -- voluntary departure -- and a signed order from a judge. For the first time, he can work legally in the U.S.
By the end of January, Zapeta may be able to earn enough money to pay for a one-way ticket home so the U.S. government, which seized his $59,000, doesn't have to do so.

Tax evasion is a serious crime. I applaud him however for not killing or raping anyone he is a credit to his race.

that he didn't rub a magic lamp and a genie gave him the money?
How do we determine the tooth fairy wasn't feeling especially generous
one night and slipped it under his pillow after he lost a tooth?
Or that Santa Claus slipped the money in his Christmas stocking?
As for the time it would take to earn the money, at $5.50 an hour
it would take 10,727 hours. Working 8 hours a day it would take him
1341 days. 5 days a week works out to 268 weeks. 56 weeks a year
works out to 4.8 years. And if he worked more than 8 hours a day
and more than 5 days a week he could have made the money even
faster. He was in the country 11 years, more than enough time to
make the money.

there are 2080 work hours in a year.That's not counting possible overtime.in a year he would make roughly $11440 before taxes. he was here 11 years.

-there is already legislation and money for 700 + miles of fense, approved. Again, the money is there. Unfortunately, it hasn't happened yet. I hang that squarely on Pres. Bush. He has let us all down on this.
-While the cost of some goods would go up, the real cost increase is not as much as you believe. A nickel or dime more per item whose cost actually rose, is a much more realistic number. Definitely not near the earth shattering $10/pd for tomatoes.
-New home cost would go up agreed. Since I own my home, I'm not real worried about that right now. However, yes you would see a slight increase in cost, and time to build I might add, until the lost labor was filled with new employees. Plenty of folks will do construction work.
-the malls and roads will survive the short duration until the open jobs are filled with legal employees.
-If i couldn't find solid and reliable work for my family and myself, I would apply for a working visa, and go to work in the states LEGALLY.

As long as he paid all the tax and the tax penalties I wouldn't have a problem. I'm pretty sure though that taking all your untaxed money and trying to flee the country would result in prison time and a huge fine. He's better off just being let go IMO.

Tax evasion is a federal statuate, punishable in federal court. He needs to pay his freaking taxes, NOW, then process in all respects followed by immediate deportation, never to return...dman

Simple solution, enforce the law of the land. I have no problem with that. Brainwashed? Far from it, I pick my battles and win quite often in life, and professionally. Taking some drug runners life as he attempted to inject our society with his foul drugs wouldn't be hate, it would be a reason to have a tall cold beer and relax. One less scumbag to worry about. It's kind of funny to me. If I snuck into another country illegally, worked a job illegally, illegally got around paying taxes, and then tried to sneak out of the country with my money, illegally, and then got caught, I would say, "Oh well, I got caught." This guy says, "I don't like this country anymore." Ha!

i will however, be taking a three or four month vacation shortly, paid I might add. All kinds of bennies you get when you retire after 30 yrs of military service, save up some significant leave days and get additional allotted time off for career transition. Looking forward to my paid vacation.......dman

I was in the Army for almost three years and did see many a career soldier on the gravy train big time, you know it happens and I know it happens, if you are not one of those than good for you. You are right I do not know your circumstances only you do.

And for your service, I thank you. And I'll agree with you, there are some gravy trainers out there. However, I, like you I'm sure given the way you stick to your guns, have never been on board that particular train. I'm a mission guy, always have been, give me a mission, it gets done, whatever the cost or sacrifice necessary. It can be no other way...dman

My point was, for the most part, we stole this country from it's legal owners, the native American and the Spanish. Not only were most of our ancestors illegal aliens but invaders as well, just the facts.

This is not worth going on about, my point is that yes there has been millions of legal immigrants but they immigrated to a place that was illegally gotten.

I'm afraid that train has left the station and won't be going back. What is done, is in fact, done. There is no earthly way to turn back time to correct issues of the past, i know I'm not willing to shoulder the blame for the sins of the past whatever they may be. A society, like each person in it, should be afforded the opportunity to learn from it's past mistakes for the most part. So, like you said, I agree, it's not worth going on about...dman

I agree we need we have a huge immigration problem and it needs to be fixed all I'm saying is lets fix it with compassion for those caught up in the broken system we now suffer under
