Just so we are on the same page. The patriot act cannot subvert the 1st Amendment on any level. Only another amendment can do that. The patriot act cannot deny any right granted in the constitution if it does then the patriot act is unconstitutional

All they have to do is label you an enemy combatant, yes even if you are an american, and your freedoms are gone.Then they can send you your ass to guantanamo to hang out with all the evil muslims.

Still shaking my head in disbelief at Garcia's ignorance.
Under the Patriot Act, your home can be entered/searched without a warrant and without your knowledge. You can be arrested and detained indefinitely without charges, without access to a lawyer, and without trial.
