Guacamole lawsuit: Where's the avocado?

LOS ANGELES -- Wholly guacamole?
That's the issue in a fraud lawsuit filed Wednesday against Kraft Foods, Inc., by a Los Angeles woman who claims the company's avocado dip doesn't qualify as guacamole.
"It just didn't taste avocadoey," said Brenda Lifsey, who used Kraft Dips Guacamole in a three-layer dip last year. "I looked at the ingredients and found there was almost no avocado in it."
She is seeking unspecified damages and a Superior Court order barring Kraft from calling its dip guacamole. Her suit seeks class-action status.
The Kraft product contains modified food starch, coconut and soybean oils, corn syrup and food coloring. It is less than 2 percent avocado, which in traditional recipes is the main ingredient of the Mexican dish.
The government doesn't have any requirements on how much avocado a product must contain to be labeled guacamole, said Michael Herndon, a spokesman for the U.S. Food and Drug Administration.
Northfield, Ill.-based Kraft said it had not seen the lawsuit but believed it was not deceiving anyone.
"We think customers understand that it isn't made from avocado," Claire Regan, Kraft Foods' vice president of corporate affairs, told the Los Angeles Times. "All of the ingredients are listed on the label for consumers to reference."
However, the company will relabel the product to make it clearer that the dip is guacamole-flavored, Regan said.

I could be wrong... But I think California is the only state in the union that could manufacture such a lawsuit.

Isn't that where they had the lawsuit of the woman who spilled McD's coffee in her lap and then sued because the coffee was too hot?

kinda, I thought she sued because the word hot as warning on the coffee was in too small a type.

Weird.
Although there is some merit to challenging what appears to be false advertising. False advertising is out of hand in the US these days.

That was a perfectly justified lawsuit. McDonalds was clearly in the wrong and part of the judgement forced them to stop serving coffee at scalding temperatures.

She sued because she was given coffee at over 180 degrees in a styrofoam cup. She suffered third degree burns to her genitals and the temperature was so severe her pantyhose melted. She was also an elderly lady.
Why on earth would anybody think serving coffee at almost 200 degrees was a smart thing to do?

they did it for shelf life. but hey they paid like a million dollars right?

I think that probably went mostly to medical bills. Skin grafts and two years of post-op therapy aren't cheap line items.
And for the record, she initially only asked them for $20,000 to help with medical costs, but McDonalds refused, offering only $800. That's when the lawyers got involved.
In the end, it was McDonald's own testimony which said that any foods hotter than 140 degrees constitued a burn hazard that lost the case for them.

Really did she really think that she would get quality Guacamole from Kraft?
She might as well sue McDonald's for saying they sell hamburgers or Pork BBQ.

What always gets me is the Kraft recipes where they try to get as many of their products into one dish that they can think of, so you end up with some kind of concoction made out of Miracle Whip and Velveeta, or something. ugh!~

I think Kraft is actually an arm of the Social Security Service that is mandated to market products that are designed to kill you after 40 or 50 years of consumption thus keeping people from collecting SS checks too long.

I know some old navy guys - and i've heard of some of the things that go on at sea -
It applies very much to the navy's slogan "if you don't like it, you aren't gay".

There's a strong difference of opinion on the merits of that suit.

Its pretty obvious the authors of that book and website are simply trying to cash in on frivolous lawsuits from a different direction.

There is no "navy" saying which says this. A story perhaps, or a running joke wrt "bubbleheads", however, trust me no truth to it. Foreign port "sweeties" flock to the pier when "boat" sailors make a port visit. What I could tell you about the austrailian sweeties, holy cow. Talk about looking for action, you literally had to fight them off during many of the port visits I made there. A single man's heaven for sure...dman
