Rush Limbaugh arrested on prescription drug charges

WEST PALM BEACH, Fla. — Rush Limbaugh was arrested Friday on prescription drug charges, with his attorney saying he has reached a deal with prosecutors that will eventually see the charges dismissed if he continues treatment for drug addiction.

Limbaugh turned himself in to authorities on a warrant issued by the State Attorney's Office, said Teri Barbera, a spokeswoman for the State Attorney's Office.

The conservative radio commentator came into the jail at about 4 p.m. with his attorney Roy Black and left an hour later after posting $3,000 bail, Barbera said. The warrant was for fraud to conceal information to obtain prescriptions, Barbera said.

Black said his client and prosecutors reached a settlement on a charge of doctor shopping filed Friday by the State Attorney, which Black said will be dismissed in 18 months if Limbaugh complies with court guidelines.

As a primary condition of the dismissal, Limbaugh must continue to seek treatment from the doctor he has seen for the past 2 1/2 years, Black said.

Limbaugh entered a plea of not guilty in court Friday on the charge and Black maintained his client's innocence.

"Mr. Limbaugh and I have maintained from the start that there was no doctor shopping, and we continue to hold this position," Black said in an e-mailed statement.

Prosecutors began investigating Limbaugh in 2003 after a tabloid newspaper reported that his housekeeper said he had used her to illegally buy painkillers. He soon took a five-week leave from his radio show to enter a rehabilitation program.

Prosecutors seized Limbaugh's records after learning that he received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach mansion. They contended that Limbaugh engaged in "doctor shopping," or illegally deceived multiple doctors to receive overlapping prescriptions.

Limbaugh acknowledged he became addicted to pain medication, blaming it on severe back pain.

According to Black, Limbaugh also has agreed to make a $30,000 payment to the state to defray the public cost of the investigation. The agreement also provides that he must refrain from violating the law during this 18 months, must pay $30 per month for the cost of supervision and comply with other similar provisions of the agreement.

Apparently, the judge has determined that Rush is guilty but is giving him the benefit of a good old-fashioned diversion program, which provides an alternative to sending a first-time perp through the justice system. Some cities have such diversion programs for juvenile and first-time adult misdemeanor offenses, and it appears Palm Beach County has a similar program. Instead of going to jail, the lawbreaker is required to pay a fine and/or perform X number of hours of community service that, if completed successfully, will help him or her avoid a criminal record. After the fines and service are complete, the offense is supposedly removed from the record.

It is disingenuous of Rehab Rush's attorney to say he plead "not guilty" today, and it's obviously just spin. Rush pleaded "not guilty" initially, almost three years ago when his case first came to court. If he were truly not guilty, the court would not be requiring him to reimburse the country for $30,000 worth of expenses of the investigation into his case, to seek medical treatment for his addiction for the next 18 months, and to pay a monthly fee to have the county confirm that he is adhering to the conditions of the diversion program during that time.

It's BS for Rehab Rush to claim he wasn't charged with anything, because if he wasn't charged then they wouldn't have a warrant out for his arrest and he wouldn't have gone to jail today and had to post $3,000 bond.

Rehab Rush should consider himself very fortunate. Diversion programs are unusual for adult felons, even first-timers. $30,000 is a drop in the bucket for Rehab Rush.

This is a favorite "Get Out of Jail Free" ploy for the rich and politically well-connected. Many of you will recall that in the book "Fortunate Son," three independent sources close to the Bush family reported that George W. Bush was arrested in 1972 for cocaine possession and taken to Harris County Jail, but avoided jail or formal charges through an informal diversion plan involving community service with Project P.U.L.L., an inner city Houston program for troubled youths at the Martin Luther King Jr. Community Center in Houston's dirt-poor Third Ward.
