Report: Feds investigating if Bonds committed perjury
Baseball isn't the only organization investigating Barry Bonds.
CNN reported Thursday that the federal government is investigating whether Bonds committed perjury when he testified during his grand jury testimony in the BALCO case in 2003.
Multiple sources told CNN that a federal grand jury has been hearing evidence for more than a month about whether Bonds perjured himself during his Dec. 4, 2003, testimony. The U.S. attorney's office in San Francisco would neither confirm nor deny to CNN that a grand jury is sitting, and Bonds' lawyers told CNN that they were unaware a grand jury is convened.
The Giants declined to comment on the CNN report to ESPN's Colleen Dominguez on Thursday night.
A number of professional athletes were given immunity from prosecution in exchange for their truthful testimony. They were also told that if it was later discovered they had lied, they would be prosecuted.
Bonds, who testified before a San Francisco federal grand jury looking into steroid use by top athletes, has repeatedly denied knowingly using performance-enhancing drugs.
Two books being released this spring accuse the Giants slugger of using steroids, human growth hormone and insulin for at least five seasons beginning in 1998 -- "Game of Shadows," written by two San Francisco Chronicle reporters, and "Love Me, Hate Me: Barry Bonds and the Making of an Antihero" by Jeff Pearlman. Baseball did not test for performance-enhancing substances until after the 2002 season.
BALCO founder Victor Conte insisted in March that he never gave performance-enhancing drugs to Bonds and that "Game of Shadows" is "full of outright lies."
Conte spoke to The Associated Press outside his San Mateo home hours after his release from prison, where he spent four months after pleading guilty to orchestrating an illegal steroids distribution scheme that allegedly involved many high-profile athletes, including Bonds.
Asked whether he gave Bonds performance-enhancing drugs, Conte said: "No, I did not."
"Game of Shadows" chronicles the founding of the Bay Area Laboratory Co-Operative and details alleged extensive steroid use by Bonds and other baseball stars. Baseball commissioner Bud Selig announced in March that former Senate Majority Leader George Mitchell will lead an investigation into the claims.
"I plan to provide evidence in the near future to prove that much of what is written in the book is untrue," Conte told the AP. He declined to list specific inaccuracies or what evidence he would provide but said the book is "about the character assassination of Barry Bonds and myself."
"It's my opinion that the two writers of the book have a disease called fabrication-itis," Conte said, holding a copy of "Game of Shadows" as he stood on his front steps.
Conte founded and managed the Burlingame-based BALCO, where the steroids were sold. He pleaded guilty to money laundering and a steroid distribution charge, and dozens of other charges were dropped as part of his plea deal.
Conte was sentenced in October to four months in prison and four months' home confinement in a plea deal with federal prosecutors.
Baseball investigators could seek to interview Conte about steroid use in the game.
Bonds, who has denied using steroids, was the most prominent athlete linked to BALCO. He testified in December 2003 to the federal grand jury investigating the case but has not been charged with a crime.
Other baseball players linked to BALCO include New York Yankees stars Jason Giambi and Gary Sheffield.
Olympic track and field stars Marion Jones and Tim Montgomery and former NFL player Bill Romanowski were also called to testify in front of the grand jury. No athletes were charged in the scheme.
Greg Anderson, Bonds' personal trainer, was sentenced to three months behind bars and an additional three months of home confinement after pleading guilty to money laundering and a steroid distribution charge.
BALCO vice president James Valente was sentenced to three years' probation, and track coach Remi Korchemny received a year of probation.
Meanwhile, baseball star Rafael Palmeiro will not be prosecuted on perjury charges after lawmakers said there isn't enough evidence to prove he lied when he told Congress under oath that he had "never used steroids" -- six weeks before failing a steroid test.
The investigation did not conclude whether the former Baltimore Orioles slugger had actually ever used performance-enhancing substances prior to his testimony before the House Government Reform Committee.
"We couldn't find any evidence of steroid use prior to his testimony," Chairman Tom Davis, R-Va., said in releasing a 44-page report. "That's not a finding of innocence, but it's a finding that we could not substantiate perjury."
At issue was Palmeiro's statement at a March 17 hearing: "I have never used steroids. Period." On May 4, he failed a Major League Baseball drug test, coming up positive for an anabolic steroid. In August, shortly after baseball suspended Palmeiro for 10 days, Davis said Congress would look into whether the player committed perjury.
"We have a responsibility, an obligation, to investigate it, and that's what we've done," Davis said during a news conference in the same hearing room where Palmeiro had testified.
Davis said the steroid for which Palmeiro tested positive is detectable for three to four weeks, shorter than the gap between his failed test and Capitol Hill appearance, and therefore "could not have been in his system the day he testified."
"We were not concerned with why he tested positive or how he tested positive except for how that related to his testimony," Davis added.

That's what his attorney is going to do and if the jury does it's job...and they will...her account of things won't matter. They need hard evidence...not people pointing figures to CONVICT him.

The point is....let me ask someone that knows you that doesn't like you and has expressed open contempt for you. As far as Bonds...I don't care about baseball. The reason I engage in these discussions is show some of you folks your ignorant ways of approaching the subject of performance enhancers in baseball. They've been doing it for a long time...the majority of them...so what's the BFD? Either you don't like Bonds the man....you don't like black americans...or your ignorant in some other way..generally hippocritical. Since baseball players in general having been using performance enhancers since the 50's it's pretty gay that you would have a problem with Bonds on this issue unless there is another reason to hate him...which is generally the case.

A federal grand jury has subpoenaed the personal surgeon for Barry Bonds to testify in its investigation of whether the Giants outfielder committed perjury in 2003 when he denied under oath that he had ever taken steroids, The Chronicle has learned.
Dr. Arthur Ting, the physician who treated Bonds for the knee injury that sidelined him for most of the 2005 season, has been subpoenaed to appear before the grand jury in U.S. District Court in San Francisco later this month, according to two sources familiar with the investigation.
The sources asked not to be quoted by name because of the sensitivity of the grand jury investigation.
Contacted by phone, Ting referred a reporter to his lawyer, Daniel Alberti.
"Dr. Ting always has been cooperative with the U.S. attorney's office, and Dr. Ting will continue to be cooperative," Alberti said.
The Giants organization declined to comment. Bonds was not available for comment, and his attorney, Michael Rains, said he was "not prepared to respond to that information."
The sources described the grand jury's investigation as an offshoot of the federal steroids case involving the Bay Area Laboratory Co-Operative, or BALCO, a nutritional supplements concern in Burlingame.
Four men, including Bonds' personal trainer, Greg Anderson, pleaded guilty to steroid-distribution charges last year as part of what prosecutors said was an international conspiracy to corrupt sports by providing undetectable steroids to elite athletes. The drugs were distributed by BALCO and Anderson.
In the early stages of the investigation, a grand jury subpoenaed at least 30 elite athletes who had been customers of BALCO -- Bonds among them.
In December 2003, as previously reported in The Chronicle, Bonds told the BALCO grand jury that he had never used steroids.
But in his testimony, he acknowledged that his trainer had supplied him with flaxseed oil and arthritis balm -- substances that matched the description of "the clear" and "the cream," two undetectable performance-enhancing drugs distributed by BALCO.
The sources said federal investigators believed Bonds lied under oath in part because documents seized in government raids on BALCO and on his trainer's home included doping calendars that appeared to reflect Bonds' drug use.
In March 2005, a former girlfriend of Bonds, Kimberly Bell, told the grand jury that Bonds admitted to her that he used steroids beginning in 1999, The Chronicle has reported previously.
Since then, the government has continued to question witnesses regarding Bonds and steroids in its investigation -- which includes looking into whether he testified truthfully -- and a grand jury began taking testimony last month, two sources said.
Bonds' lawyer, Rains, said that last month he contacted the U.S. attorney's office in San Francisco to find out whether it had completed any investigation involving Bonds.
"I got the typical federal answer: 'We're not going to say one way or another,' " Rains said.
Rains has maintained throughout the investigation that the government was out to get Bonds. "It's always been the U.S. versus Bonds, and they're always just gunning for the big guy," the lawyer said in March 2005.
Ting is of interest to investigators because he has visited BALCO with Bonds, the sources said. In September 2003, a BALCO employee told federal investigators that around that time, Ting had accompanied Bonds to the lab and had drawn his blood for testing.
The doctor has been Bonds' personal surgeon for much of the outfielder's San Francisco career. In 1999, when Bonds suffered a serious elbow injury, Ting operated to repair the damage. Last year, Ting performed three operations on Bonds' ailing knee -- two to repair torn cartilage and a third to combat an infection that had developed after the surgery.
Ting's patients include many elite athletes, and he is among the best-known orthopedists in the region. But public records show he has twice been disciplined by the state Medical Board.
In 1996, Ting was put on probation after he allegedly allowed a medical technician to diagnose injuries and write prescriptions. He ultimately admitted only to improperly failing to diagnose and treat a patient's elbow dislocation.
In 2004, the board put Ting on probation, this time after he was accused of prescribing drugs to friends and keeping inadequate records. Ting acknowledged he was "negligent in his supervision of subordinates" but denied wrongdoing on the other issues.
The probe of Bonds is the latest twist in a case that has grabbed headlines, mostly because of BALCO's celebrity clientele.
In a statement to federal agents at the time they raided his laboratory in September 2003, BALCO founder Victor Conte identified 27 stars of baseball, football, and Olympic track and field to whom he said he was providing designer steroids. Some of the drugs were created to be undetectable on conventional steroid tests.
Among the athletes Conte named were New York Yankees Jason Giambi and Gary Sheffield, track and field superstar Marion Jones and Bonds. Conte later renounced the statement, but his top assistant at BALCO, James Valente, also gave a statement to federal investigators in which he said Bonds and Giambi had been provided BALCO drugs through Bonds' personal trainer, Anderson.
Conte, Valente, Anderson and veteran track coach Remi Korchemny were indicted on steroid conspiracy charges in 2004. But steroid dealing carried relatively light penalties under federal law, and the cases were settled with plea bargains last year. Conte served four months in federal prison, and Anderson served three months. They are now under house arrest. Valente and Korchemny were put on probation.
But investigators continued to pursue the case, and in November, an Illinois chemist, Patrick Arnold, was indicted for allegedly creating one of the undetectable steroids that BALCO had distributed. After Arnold's indictment, the sources said, the investigators continued an inquiry into the truth of Bonds' 2003 grand jury testimony.

The AL instituted the DH to increase run production to salvage attendance and revenues. Voila, DH instituted and gate goes up. What's to say that Buddy Selig isn't following the same formula for increased gate when it comes to the "cream and the clear"? I'm a pitchers duel, run creation type guy. I like bunting, swiping, opposite field singles and such for run production. But I'm also in the minority. Whatever happens, Buddy boy needs to be checked out as to, forgive an overused phrase here, figure out what he knew and when he knew it.

You guys are making me laugh...they had Bill Clintons DNA on a dress and couldn't convict him of perjury 43 million later. I hardly think the "feds" are a slam dunk on this.

Those celebrities couldn't beat the Feds in court for their crimes. BTW, U.S. Congressman Duke Cunningham was a Republican big wig and decorated war pilot who went down for 8 years for accepting military contract bribes.
The Feds have overwhelming evidence against Bonds. During the grand jury testmony, the Feds were only interested in busting the steroid dealers i.e. BALCO and gave immunity to the players if they testified truthfully. Bonds had every opportunity to get out of this mess and he lied. He's going down.

Unless it's hard evidence they're going to have a hard time proving that he did lie under oath. Charts can be forged. And don't be fooled. This entirely is about putting pressure on him and nothing else. I understand that suits your interests since you consider him a cheater, but call it like it is.
