The Indianapolis Colts are exploring their options in the aftermath of an arbitrator's ruling prohibiting them from gaining salary cap relief by addressing roster bonuses due quarterback Peyton Manning and Marvin Harrison.


One option could be litigation.
Dan Emerson, the Colts' general counsel, said the team has not ruled out seeking a temporary injunction to Wednesday's decision by Stephen Burbank, a professor at the University of Pennsylvania Law School. Burbank, a special master who arbitrates disputes within the NFL, ruled the Colts could not convert substantial roster bonuses due Manning and Harrison into signing bonuses and prorate them for four years to lower each player's hit against the salary cap.
It's an issue now because there is no NFL labor agreement extension. If an extension were in place, the Colts would be able to restructure the contracts as they have in the past.
Burbank's decision left the Colts well over the $94.5 million salary cap that goes into effect at 12:01 a.m. Monday.
"No injunction has been filed,'' Emerson said. "We're cautiously optimistic that no injunction will need to be filed.''
The trigger for legal action could be the inability of the NFL and its players to reach resolution this weekend on an extension to the collective bargaining agreement. Minus an agreement, the Colts could be as much as $10 million over the cap, in large part because they are carrying Manning at $17.8 million and Harrison at $14.4 million.
An agreement might boost the salary cap as high as $105 million and enable the Colts to do the normal bookkeeping measures to lower the cap numbers of Manning and Harrison.

At what point do they have to start cutting players?

I hope they have to make those cuts, then 5 minutes later the CBA is agreed upon, and they can't get those players back. That would be funny.

All the players need to go thru the waiver wire, before it offical. So the CBA would need to happen tomorrow, for cuts to be good today.

Manning has no one but himself to blame for the Colts salary cap predicament. He's the one who mortgaged the future of the team for a huge, long term contract.

That's not going to happen.. The Skins have restructured contracts with multiple high-salary players waiting in the wings if the CBA extension falls through. There will be no mass purging in DC. However, they will be very limited for any free agent moves and will be lucky to have enough $$ to resign their own FAs and draft picks..

I think a deal is going to be done today, the cap will be raised and then it's GAME ON! :D

We'll, you'll probably have to get used to that because of the level of jealousy that accompanies players like that. Peyton's great. No arguments from me there. You cant expect every Bronco fan to agree though. You're talking about the land of John Elway here.

are peyton and john yin and yang? if I remember correctly john elway lost a lot of big games. the only difference I can see is that when john was around the power was all in the nfc, now the dynasty(the patriots) are in the afc.

oh well, just pointing it out.

The point was that Peyton will get downgraded in Denver because Bronco fans got to watch a legend in action for years. He'll be held to a higher standard and critiqued by fans who saw a QB who performed at the highest level possible. You are making a mistake by thinking Bronco fans will drink the Peyton-aid readily when they thought so little of guys like Marino.

and peyton has spanked the broncos absolutely silly. I'm not saying they have to change, but I'm still going to point it out.

I think its more like fans get tired of hearing about how great he is. Rules get changed for him, and the media hypes the hell out of him. People are growing tried of hearing about the Pats as well. The same reasons why they give them props...winning with all those injuries, then coming back after a lose to say well teams can't win with that many injuries. It should only work one way.
I doubt people don't agree he is a good QB, its the media hype that follows him that pisses people off.

just to use this thread I talked to ppl about this and I think the colts have done several things wrong.

they have made a mistake about the composition of their team. harrison had his last large year and they resigned him and now he is really the most overpaid player on the team. their general want to keep resigning all their skill offensive players have made them let two pro bowl linebackers go. also now they have a bunch of defensive talent that could play well for years, but they have glenn, stokley, wayne, manning, harrison, diem all signed to hefty deals. and then there's dallas clark.

it would have been better IMO for them to lose both wayne and harrison, keep stokley and clark and then on defense sign simon, doss, sanders, mathis, freeney, thornton, bracket, june, brock. all those guys are good and could be a serious defense together.

offensively keep average wr's and an above average offensive line and rely on peyton to do the rest. all peyton really needs at wideout are ppl who can beat single coverage, he can really handle the rest.

You gave some good insight there with that post. Peyton is hyped quite a bit and moreso than Marino. I think that Marino was the original Peyton, and was actually a more fierce competitor but Marino could never get over the hump. The guy never really had a team anywhere close to the teams that Manning has played with over the past couple of seasons. Marino never had that O-line, an Edge James type back, or a Dwight Freeney (until he was washed up).

The team restructured the contracts of quarterback Peyton Manning and wide receiver Marvin Harrison, creating approximately $12.5 million in cap savings. Manning provided about $5 million and Harrison approximately $7.5 million in cap relief, according to a person with knowledge of the situation.
Had the Colts not restructured those contracts, they would have faced the task of cutting players to be in compliance with the salary cap if a new contract is not eventually worked out. Late Sunday the league and the players' union agreed to delay the start of the free agent period another 72 hours to give the sides more time to try to reach an agreement.
The Colts faced the possibility of being nearly $10 million over the cap last week after special master Stephen Burbank, a professor at the University of Pennsylvania Law School, ruled they could not restructure the contracts of Manning and Harrison to convert roster bonuses into signing bonuses. Burbank ruled the restructuring violated provisions that go into effect without an extension to the collection bargaining agreement.

When you restructure, your really just putting the money off until later right? So all of Mannings restructuring will eventually come back to one big cap hit later?

Thats saying that the cap grows exponentially with his contract. I really don't know much about this cap stuff, but I have to think that with his contract, it will eventually come around to bite the Colts in the ass.
