WASHINGTON - Justice Sandra Day O’Connor, the first woman appointed to the Supreme Court and a key swing vote on issues such as abortion and the death penalty, said Friday she is retiring.

O’Connor, 75, said she will leave before the start of the court’s next term in October, or when the Senate confirms her successor. There was no immediate word from the White House on who might be nominated to replace O’Connor.

It’s been 11 years since the last opening on the court, one of the longest uninterrupted stretches in history. O’Connor’s decision gives Bush his first opportunity to appoint a justice.

Hopefully far enough right to off set the leftist slant of the SC. Ok not really hopefully Bush has the guts to find someone who will follow the laws of the land the way they were ment to be followed and not make rulings based on their own agenda. I know I know its a pipedream.

Actually I dont have a realProblem with Scalia his ruling in the UNION, UNITED AUTOMOBILE,AEROSPACE AND AGRICULTURAL IMPLEMENTWORKERS OF AMERICA, UAW, et al.,PETITIONERS v. JOHNSONCONTROLS, INC. .was particaly right , he did have some things in his conncurence i didnt agree with like the Lead effecting Mens reproduction abilty , but in the end Scalia came through . and thats all that matters

Rep! I have no problem with scumbags spending the rest of their days four stories underground under flourescent lights for the remainder of their days. Personally, I would find that more horrible than getting put to sleep. I just don't agree with the concept of a democratic state putting its citizens to death for any reason.

I know nothing about her really but I do have a nice story about the justice system. I guard at the hospital my wife works at got stabbed to death a couple days ago, by a man you just got out of jail that very same day. He was out on a million dollar bail or 10%. Nice.

I don't, I don't agree totally with everything that is going on over there, but I damn sure rather see the fight abroad than on U.S. soil.

I read a report than 90% of the people fighting the U.S. in Iraq isn't even from there they are infiltrating thru Iran and Syria.

War sucks, people die, but doing it the liberal way and throwing $$$ at a problem doesn't always work.

All law is gray area. No one introduced it. It actually requires it. Its no one's fault, its part of life. Language is slippery. Its hard to use any word whereby you know the exact parameters of prohibited conduct on all sides without being unnecessarily restrictive.

Which goes back to my belief that unfortunately, we have been passing more laws, instead of looking at and either enforcing or abolishing the laws that we currently have. It appears as if the judicial branch has forgotten that, so we tack on more laws that make our personal rights and freedoms more restrictive. My only hope is that her replacement will not mess with Roe v. Wade, and yet not be so quick to just make new laws to fill in the "grey area."

That's a real shame for this country. She was one of the centrists. Bush will now fill her role with some slavering right wing pedagogue like Scalia. Then Rehnquist will drop dead and Bush will get another one. Oh well. I've always had a historical interest in the Medieval times. If Bush gets his way, maybe I'll get the opportunity to see it first hand.

Couldnt agree more. Being a linguist by education I certainly understand the ineffectiveness of language to express ideas.

FDR and HST were not liberals, the parties changed when DDE became the first conservative republican. The father of modern liberalism would be JFK. Prior to DDE, the republicans were considered the liberal nutsacks.

The only problem I had with Sandra, was she introduced the idea of the "grey area" of the law, for which civil and defense attorney's have been playing in ever since.

I think everybody over at the Carlyle Group or the Heritage Foundation would disagree with you about FDR and HST. After all, they've spent their entire political lives trying to undo everything FDR ever accomplished.

I think this court ended up being very centrist. What it seems to me that they tried to accomplish was to force politicians to face up to the issues instead of continuously dumping them in the court's lap. That's why they sent so many cases back to the state courts.

With the chief centrist conservative now gone the right wing should be able to enforce its agenda through judicial activism.

9/11 Commission Report: "Osama offered to Clinton by Sudan" Claim is Bogus

Regular viewers of Hannity and Colmes on Fox News (Read: Raiders Rock) have heard Sean Hannity say on numerous occasions that the government of Sudan wanted to hand Osama bin Laden over to the United States "on a silver platter," only to have the offer rejected by the Clinton administration.

Hannity says this a lot. If the topic of the day is terrorism, it's a sure thing Sean Hannity will mention the alleged offer by Sudan to turn Osama bin Laden over to the United States.

Fox News analyst Mansoor Ijaz has made the claim that he brokered the deal to turn over bin Laden, as a sort of freelance diplomat.

Ijaz claims that in 1996, he opened talks with the government of Sudan. According to the December 5, 2001 Los Angeles Times, Ijaz says, "From 1996 to 1998, I opened unofficial channels between Sudan and the Clinton administration. I met with officials in both countries, including Clinton, U.S. National Security Advisor Samuel R. "Sandy" Berger and Sudan's president and intelligence chief. President Omar Hassan Ahmed Bashir, who wanted terrorism sanctions against Sudan lifted, offered the arrest and extradition of bin Laden and detailed intelligence data about the global networks constructed by Egypt's Islamic Jihad, Iran's Hezbollah and the Palestinian Hamas."



Was this a legitimate offer? According to the 9/11 Commission's final report, the answer is no.

In the 567-page report, the 9/11 Commission mentions Ijaz only once, as an end note on page 480: "In February 1997, the Sudanese sent letters to President Clinton and Secretary of State Allbright, extending an invitation for a U.S. counterterrorism inspection mission to visit Sudan. The Sudanese also used private U.S. citizens to pass along offers to cooperate...but these offers were dismissed because the National Security Council viewed Sudan as all talk and little action...U.S. officials also feared that the Sudanese would exploit any positive American responses..."

What about the claim, as articulated by Hannity on hundreds of occasions, that we were offered Osama bin Laden on a silver platter? The 9/11 Commission report says it never happened. From page 110 of the report:

"Sudan's minister of defense, Fatih Erwa, has claimed that Sudan offered to hand bin Laden over to the United States. The commission has found no credible evidence that this was so. U.S. Ambassador Timothy Carney had instructions only to push the Sudanese to expel bin Laden. Ambassador Carney had no legal basis to ask more from the Sudanese since, at the time, there was no indictment outstanding."

For years now, conservatives have battered Clinton over his "failure" to accept bin Laden on a "silver platter." Ijaz has made the cable news circuit on many occasions with his claim that he brokered a deal to hand over bin Laden.

Of course, conservatives have always believed the Ijaz story and never accepted the Clinton administration's explanation of the "offer." As Clinton National Security Advisor Sandy Berger wrote in the July 13, 2002 Washington Post: "Although less was known about Osama bin Laden in 1996, when he left Sudan, than has been learned since, U.S. officials pressed the Sudanese to end their support and sanctuary for bin Laden. But no senior Clinton administration official -- from the State Department, the CIA, the Defense Department or the National Security Council -- is aware of any offer by the Sudanese to turn bin Laden over to the United States..."

Berger also adds, "...that he (Ijaz) was not used as a channel of communication by the U.S. government to the Sudanese reflects the disinclination of any administration to use self-appointed diplomats to conduct official U.S. business -- given uncertainties over motivation and interest. Indeed, other governments complained to U.S. officials that Ijaz represented himself -- incorrectly -- as acting on behalf of the U.S. government."

To be fair, attempts were made in 1998 to capture bin Laden, and government agencies developed plans to do so. Following the 1998 embassy bombings in Africa, the Clinton administration decided to attack the camps bin Laden used with cruise missiles. The missiles were fired on August 20, 1998. According to the 9/11 report, bin Laden was missed by a few hours.

Conservatives like Hannity have said for years that the Clinton Administration did nothing to stop terrorism. The 9/11 Commission report shows the administration did take action against terrorists, and describes the Clinton Administration as being "obsessed" with capturing bin Laden.

Of course, in the world according to Sean Hannity and other conservatives, Bill Clinton took no action against terrorism, and it's doubtful the 9/11 report will change their minds.

I remember her being appointed by Reagon. She has been a pretty fair Justice. She'll be tough to replace. I'm sure getting a legal abortion in the US will be impossible now. Back to the 1800's with coat hangers and back alley Drs.There are only 3 anti-abortion judges on the court right now according to the Tucker Carlson show and Rachel Maddow, an Air-America talk show host and liberal activist, was there and could have corrected him. She did not. So even if the next Judge is pro-life that makes the vote 5-4 for Pro choice.

Plus I don't understand why abortion, gay marriage, all the social issues are not voted on by the people and not judges, be they liberal or conservative. Let the people vote on it.

Well my money is on Mikey Luttig on the 4th Circuit, unfortunately.

He is basically the perfect choice for Bush: He's young, silly conservative (especially on the "morality" issues), and has made it his personal policy to NEVER make political speeches - in anticipation of his confirmation, I'd guess. I have heard that he has only spoken in public twice, and one of those speeches was at the funeral of Ted Olsen's wife who was on the plane that hit the petagon. And here's the kicker: someone in his family was murdered (his father or son, I can't remember), and he refused to let the state go for the death penalty. So, there is no dirt on this guy and no solid ground on which to oppose his confirmation, except ideology, and the dems can't afford an ideological battle right now. He's the smart pick anyway...

Back to the point of this thread. Man! I can only imagine the fireworks that are going to explode in DC over this one. Completely unexpected. There will be all out war on capitol hill.


The all-out war has already happened with the nominee filibustering. If I remember correctly, all that Bush has to do is say the word and we have a new Supreme Court justice.

The republicans have control of both houses, so it was inevitable anyhow. Hopefully Bush will finally give me something for my vote and put an originalist in there.

O'Conner was a great judge and I hope she has a good life, she has deserved it.
