So much for swearing this place off. :pigsfly: What can I say, when you got to have your Planet fix you'll do 'bout anything to get it.

Why don't you dopes ever hang out with Joe Seahawk when the Planet is down (that's where I'd be if I knew where he posted)?

JazzzLovr

When I talked to Phil last night, he hadn't had any warning about it either. So I really doubt that this is anything but an unplanned outage. I don't know if he's had a chance to talk to Kyle since then, so I haven't heard yet if we have any idea when it will be back up.

That's all I know for now.

Could just be Kyle's way of putting an end to the bickering caused by the split board. Unexpectedly take it away from all for a couple of days while doing the upgrade. Then when it's back up, the only thing people will care about is that it's back up.

Or I could just be really reaching here....

Saul-
Question- on the issue of burning the Montana/Elway 94 VHS to DVD, were you gonna compress the file so all 3+ hours fit on one disc? In my DVD authoring experience, if you cram much more than 1-1.5 hrs. on a disc, you run the risk of losing quality. I know the REALLY high-end movie production burners in Hollywood can burn to both sides, but I don't think they're commercially available to us common types yet.

BTW- have you got the tape you're going to use yet? I forgot to bring mine in to work to check the quality, but I still will if you haven't settled on a source tape yet..

All depends on how it looks. I think people would sacrifice quality for the convience of having it on one disc, especially coming from a VHS transfer. A digital transfer would be much different...:) And I haven't gotten any source tapes yet.

Also, Dual-Layer burners will be available in retail stores this summer, starting at around 149.99-199.99. Media is what will get you. GENERIC Media is running about 2.50 a disc, not meant for video use.

Great news about the daul layer burners! I didn't realize they would be available either that soon or that cheap!
Not understanding what you mean for sure on the media part- not meant for video use? What can you use them for? I think I'm currently paying like $1.50 a pop for the single-sided DVD-Rs...

Not meant for video use, meaning the quality of the disc isn't up to par like the real video discs are. If you are paying around 1.50, you should be getting premo discs. I pay around 1.00 a piece for +R's, meant for video quality. If you buy generic, general purpose stuff, its around 65-80 cents a disc.

it was indeed 1970, but the first week of 1970.
it was the culmination of the 1969 season, which means their last championship SEASON was 4 DECADES ago.

Not to bad realy , I am ok with the hole Denver dug itself from 1960 - 1977
We sucked back then , But since 1995 Life has been good ......
See I became a fan Back in 72 , and I admit we sucked but you can only dream of how it felt to win a SB after Sucking for so long .......
I know that Feeling I have experienced it ....... and al you have is a lead in wins aver 40 years .......... Just doesnt feel the same .............

we've gone through this before.
its so pathetic that you have to go back to our vertically striped sock days to find an advantage.
ever break down those numbers?

do so, and you'll see that since our FIRST playoff appearance in 1977, we have a DECIDED advantage.
if you want to hang your hat on games played between 1960 and 1976, thats fine by me, but dont try and pass it off like your team has anything on us.
since your last superbowl win we've played in six, and won two.
try again.

Can't argue with the numbers. We beat you 3 decades ago, we beat you 2 decades ago, we beat you 1 decade ago, etc etc. But its silly, just as silly as saying you are better because you have more championships.

oh, i dont argue the numbers.
essentially, you guys absolutely DOMINATED between 1960 and 1976. since then, we have a decided advantage. i guess my point is just that its EXTREMELY misleading to show the all time series numbers without breaking it down and explaining why those numbers are where they are.
we have a reasonable advantage in the series since 1977, but we were so totally dominated prior, it will take awhile to even it out.

as for the colts, you are right. those were two ugly games.
most of my orange mane brethren (and sisters ladies!!) were rooting for the colts, but after the a$$ beating they gave us, i admit i wanted them gone. i was actually pulling for you guys. (i cant believe i just admitted that!)
what a joke those two games were. both our teams just played flat. indy had a very good team, but not decidedly better than the chiefs or the broncos. the better team does not always win.

im sure we can all agree that this coming year will be exciting, and its a fun time to be a fan of either of our teams.
so, how do you feel about opening the season in our back yard?

Learning to Fly (Gilmour,Moore,Ezrin,Carin) 5:06

Into the distance, a ribbon of black
Stretched to the point of no turning back
A flight of fancy on a windswept field
Standing alone my senses reeled
A fatal attraction holding me fast, how
Can I escape this irresistible grasp?

Can't keep my eyes from the circling skies
Tongue-tied and twisted Just an earth-bound misfit, I

Ice is forming on the tips of my wings
Unheeded warnings, I thought I thought of everything
No navigator to guide my way home
Unladened, empty and turned to stone

A soul in tension that's learning to fly
Condition grounded but determined to try
Can't keep my eyes from the circling skies
Tongue-tied and twisted just an earth-bound misfit, I

Friction lock - set.
Mixture - rich
Propellers - fully forward
Flaps - set - 10 degrees
Engine gauges and suction - check

Mixture set to maximum percent - recheck
Flight instruments...
Altimeters - check both
(garbled word) - on
Navigation lights - on
Strobes - on
(to tower): Confirm 3-8-Echo ready for departure
(tower): Hello again, this is now 129.4
(to tower): 129.4. It's to go.
(tower): You may commence your takeoff, winds over 10 knots.
(to tower): 3-8-Echo
Easy on the brakes. Take it easy. Its gonna roll this time.
Just hand the power gradually, and it...

Above the planet on a wing and a prayer,
My grubby halo, a vapour trail in the empty air,
Across the clouds I see my shadow fly
Out of the corner of my watering eye
A dream unthreatened by the morning light
Could blow this soul right through the roof of the night

There's no sensation to compare with this
Suspended animation, A state of bliss
Can't keep my eyes from the circling skies
Tongue-tied and twisted just an earth-bound misfit, I

That's your guy's call... I'm just sharing my thoughts on the matter as a webmaster. If it were me and my webspace, I'd recuse myself from getting involved with someone's trademark infringement due to the legal liability that comes with it. I know based on my own research that Kyle has got some sort of partners who have registered all of the teamplanet.com domains. You're exposing yourselves and Kyle to potential legal headaches that are wholly unecessary when you step outside of his authority with the trademark and register a domain name that he and his partners now have to account for.

For the record, I hope nobody ever tries it with the Orange Mane, and instead will have faith that I'm working diligently to resolve any issues before commandeering my creation and creating a copycat forum complete with copycat domain name without first consulting with me on the idea.

Good intentions aside, you're playing with someone else's baby without checking with them first to see if it's ok.

Chiefs Planet is a trademark. According to the lawyer I consulted with when first setting up my domain, I have legal rights to anything with the words Orange Mane in it. I think I'll take the lawyer's word over the IT guy.

I disagree with your assessment that there would be no case... I doubt it would ever go to court. But that's not the point. As the owner of the trademark, Kyle and any partners he has now have to account for another domain name. I doubt that is something that he/they wanted dropped in their lap, despite the good intentions behind it.

Indeed. I'm always quick to dismiss an opinion I know is wrong.

When I have a lawyer tell me one thing about a legal issue... and an IT guy tell me a different thing about a legal issue... Whose opinion do you think I should discard?

It's not my domain name, so it doesn't really matter to me. I'm just saying the least that could be done is that Kyle be contacted first before commandeering his trademark, despite perceptions of necessity. It's the least that could be done out of respect for the guy.

As I stated before, I am in total agreement with contacting Kyle. I think the whole idea is cheesy as well. I totally agree with you in all aspects except for it being a copyright infringement. I also do not disregard your lawyers statement. What i would imagine, is you did not correctly understand your lawyers comments. I'll give you the most basic example of this.

www.whitehouse.gov vs. www.whitehouse.com

Copyrighted, trademarked, united states government website vs. a porn site. And heck, they didn't even change the name, just the domain.

whitehouse is not a trademark... That's a bad example... There is no copyright or trademark for whitehouse.gov. It's not a private enterprise. They have no use for trademarks.

Here... Try this. I dare you to prove that I'm wrong, and register the domain DrudgeReport2.com and tell me how long it takes to get a letter from a lawyer.

Taco...

first.............type in "thedrudgereport.com" and "drudgereport.com"....

I'd question something on your assessment..........While Kyle did write the script and create the planet....it seems to me like the users created and voted on the name in the first place.....the users have donated money over the years to keep it running.................wouldn't that give the users a little more leeway?

Personally....I don't give a crap........I just wish Kyle would fix the problem..............I'm glad he's making some jack on the idea...............but the dedication to the Chiefs fans isn't what it once was.............

Taco John
06-02-2004, 08:05 AM
Ok... So Drudge isn't going to prosecute... Especially since the rival site isn't trying to present news... But if they tried doing the same thing Drudge is doing, I bet it would be a different story... and I doubt Kyle would prosecute either... But the law is on the side of the person who owns the trademark (http://www.bc.edu/bc_org/avp/law/st_org/iptf/headlines/content/1996112104.html).

And again, it doesn't much matter to me. I just think that out of courtesy, Kyle should be contacted before using his trademark... User voted and supported or not, he owns the trademark, along with quite a few other teamplanet.com domain names... Do a whois search, and you'll see what I mean. It's not difficult to contact the guy and run the idea by him. Anyone who can register a domain name has the tools to contact the guy and run it by him.

But whatever... I'm just pointing it out with the intentions of protecting those involved from potential headache... Take it or leave it. No matter...

ndbbm
06-02-2004, 10:01 AM
See, that works with yahoo.com and theyahoo.com as well. It even works with microsoft websites. All i was trying to point out was there was not a trademark infringement in doing this. And I believe your lawyer may need to be doing a better job in explaining these things to his clients.

Here... Try this. I dare you to prove that I'm wrong, and register the domain DrudgeReport2.com and tell me how long it takes to get a letter from a lawyer.Difference being, I don't know Matt Drudge, and he doesn't know me. He would be well within his rights to question me and shut my knockoff site down if I was trying to bank off of his success without his consent.

I think Kyle would be a bit more understanding when one member of his community makes a backup site for users when his is down and another member registers a domain name similar to his that redirects to the aforementioned backup site.

No one's depriving him of any profits or exposure, no one's trying to steal or otherwise deceive the members who frequent the community he's created, and the Chiefs or the NFL are not going to say, "ChiefsPlanet I can deal with, but ChiefsPlanet2? What an egregious, intolerable slap in the face! We will bring the creator of ChiefsPlanet down, even though he has nothing to do with the ChiefsPlanet2 backup website created by the members of his community during a time when its server went down."

Maybe it should be called ChiefsPlanB, or something, instead of ChiefsPlanet2. Whatever. But it's hardly the major issue that you're trying to stir it into/portraying it as being.

Difference being, I don't know Matt Drudge, and he doesn't know me.

It's not that I'm trying to make it a big deal... I'm just trying to keep people from putting Kyle in an akward position for no good reason. ChiefsPlanet is his property, and it would be prudent to consult him. That's all I'm saying.

That's not groundbreaking at all, or a major issue. It's just courtesy. That's not saying that Kyle is going to pursue legal action or anything. It's just saying that ChiefsPlanet is his intellectual property, and any offshoots should be under his advisement. I'd hope that I would be consulted were I in a similar situation.

No problem...

No webmaster that I can imagine would appreciate that no matter how well intentioned it is... It's a serious no-no...

Don't know if I can say this or not, but I think Taco is actually R... R... R... R... R... R... (nope, it just wont come out but it starts with R and rymes with Tight) on this one.

Attention, ChiefPlanet regulars:

If the colors get too bright over here, come over to....

TJ has been gracious....but in case you wanna rail against him or the Broncos, and not feel bad about doin' it on HIS board....Saul has set us up.

:wiggle:

What's the point of posting over there so more of my threads/posts can get deleted by the Mod?

No thanks. I think I'd rather visit a Raider BB.

While I agree that just adding a "2" to the end of the name may just be pushing the envelope, I can't honestly see Kyle getting his panties in a wad.

The real planet is down, and as long as Saul dumps the site once the real one is back up (or at least puts it on ice until it's needed again), Kyle would probably be appreciative that Chiefs fans had a site to post on that wasn't run by the enemy.

(No offense, Taco. You've been a great host ... some of the members here have been douche bags -- very, very few -- but I guess that's to be expected.)

I don't know whether Taco is right about this being a trademark issue or not, but if it is, it doesn't matter whether it is being infringed by friends (with no financial motive) or strangers (in an attempt to siphon off customers). If there is infringement, the trademark holder has to take action to stop it or he/she loses their rights to that trademark. This is why you sometimes hear about a big company forcing some innocent kid to cease and desist on something that seems pretty petty. If they let the infringement slide in the petty situations, then when they need to enforce their rights they will find that they can't. It's just another bizzaro feature of our intellectual-property-laws.
